MUNICIPAL
COURTS OF THE PROVINCE OF LEYTE AND SOUTHERN LEYTE, INCLUDING THE
CITIES
OF TACLOBAN AND ORMOC.
SUBJECT:
AMENDMENT
TO MEMORANDUM CIRCULAR DATED SEPTEMBER 9, 1975.
For the
information
and guidance of all concerned, and in line with the doctrine laid down
by this Court in G.R. No. L-44113, entitled "People of the
Philippines
vs. Hon. Judge Mericia B. Palma and Romulo Intia y Morada,"
promulgated
on March 31, 1977, the Memorandum Circular of this Court issued on
September
9, 1975 is hereby modified to read as follows:chanrobles virtual law library
"For the
purpose
of implementing Administrative Order No. 172 dated October 14, 1974 of
this Court, and as a corollary thereto, all criminal cases where the
only
accused or all of the accused be under sixteen (16) years of age,
except
those falling under the concurrent jurisdiction of the Juvenile and
Domestic
Relations Court and the city and municipal courts as mentioned in
paragraphs
1 and 2 of Section 1(a) of Presidential Decree No. 411, shall be
included
among the cases transferred to the Juvenile and Domestic Relations
Court
at Tacloban City: Provided, That if only one, or some, but not
all
of the accused in a case are below the age of sixteen years, the
jurisdictions
over the said criminal cases shall be retained by the regular courts
pursuant
to the penultimate paragraph of Section 1 of Presidential Decree No.
411."Please be
guided accordingly.
