CALENDAR OF ACTIVITIES AND PERIODS
OF PROHIBITED ACTS IN CONNECTION
WITH THE MAY 14, 2007 SYNCHRONIZED
NATIONAL AND LOCAL ELECTIONS

[Promulgated on 30 August 2006]


Pursuant to the powers vested in it by the Constitution of the Republic of the Philippines, the Omnibus Election Code (B.P. Blg. 881), Republic Act No. 6646, 7166, 8189, 8436, 9189 and other election laws, the Commission on Elections RESOLVED to prescribe as it hereby prescribes the following Calendar of Activities and Periods of Prohibited Acts in connection with the May 14, 2007 synchronized national and local elections:

July 26, 2006 (WED) to August 12, 2007 (SUN) (Comelec Resolution No. 7686 dated July 17, 2006)

 

Prohibition on the transfer, promotion, extension, recall of any member of the foreign service corps, including members of the attached agencies, or the movement of any such member from his current post or position

September 30, 2006 (SAT)

Last day to file application for registration / certification as overseas absentee voter and application to vote in absentia (Section 4, Comelec Resolution No. 7447 dated 18 March 2005).

Last day for filing of application for transfer of overseas registration record from one Post to another or from one country to another under the same consular jurisdiction of the Post or from Post to a Philippine city/municipality other than the original residence of the applicant (Sec. 19 (A) (B) and (D), Comelec Resolution No. 7447 dated 18 March 2005).

 

September 16, 2006 (SAT)

Last day to file petitions for registration of political parties, parties, coalitions of parties and sectoral groups participating in the party-list system of representation

 

October 31, 2006 (TUE)

Last day to file application for transfer of overseas registration record from Post to the same Philippine city / municipality comprising original residence of applicant (Sec. 19 (C), Comelec Resolution No. 7447 dated 18 March 2005).

 

November 21, 2006 (TUE)

Last day of hearing of applications for registration/certification as overseas absentee voter (Section 12, Comelec Resolution No. 7447 dated 18 March 2005)

 

December 15, 2006 (FRI)

Last day to prepare the National Registry of Overseas Absentee Voters (NROAV) (Section 17, Comelec Resolution No. 7447 dated 18 March 2005)

 

Not earlier than November 30, 2006 (THU)

Party convention to select and nominate official candidates for all positions (Sec. 6, RA 7166 in relation to Sec. 29, RA 6646)

 

December 29, 2006 (FRI)

Filing of petitions for exclusion of registration record of an overseas absentee voter: a) If approved by the local ERB in connection with the 10 May 2004 Elections, with the proper Municipal or Metropolitan Trial Court; b) If approved by the RERB, with the MTC-Manila

Last day to file application for reinstatement or correction of name of voters excluded from the NROAV through inadvertence or registered with an erroneous or misspelled name.

Last day to file application for registration, transfer of registration records, etc. (Local registry)

ELECTION PERIOD

Alteration of territory of a precinct or establishment of a new precinct (Sec. 5, RA 8189);

Bearing, carrying or transporting firearms or other deadly weapons in public places, including any building, street, park, private vehicle or public conveyance, even if licensed to possess or carry the same, unless authorized in writing by the Commission (Sec. 261 (p) (q) (s), OEC as amended by Sec. 32, RA 7166).

Suspension of elective local officials (Sec. 261 (x), OEC)

Transfer of officers and employees in the civil service (Sec. 261 (h), OEC)

Organization or maintenance of reaction forces, strike forces or other similar forces (sec. 261 (u), OEC).

Use of security personnel or bodyguards by candidates, whether or not such bodyguards are regular members of the AFP or PNP or other law enforcement agency (Sec. 261 (t), OEC, as amended by Sec. 33, RA 7166).

Period to file certificate of candidacy for Senators

Period to file manifestation of intent to participate in the party-list system of representation.

Last day to file petition for inclusion of qualified voters in the local registry.

Posting of the certified list of voters (Local)

Campaign period for Senators and political parties, organizations or coalitions participating under the party-list system of election (Sec. 5, RA 7166; Sec. 4, RA 7941)

 

February 13, 2007 (TUE) to May 14, 2007 (MON)

 

Giving of donations or gift in cash or in kind, etc. (Sec. 104, OEC)

Use of armored land, water or aircraft (Sec. 261 (r), OEC)

Appointment or use of special policemen, special/confidential agents or the like (Sec. 261 (m), OEC)

February 28, 2007 (WED)

Last day to appoint members of the Boards of Election Inspectors, subject to changes on account of lack of public school teachers and disqualifications due to relationships to candidates (Sec. 164, OEC in relation to Sec. 31, RA 8189)

Issuance and sending of notices of inspection and verification of completeness of VRRs for each precinct book of voters (Sec. 31, RA 8189)

Appointment or hiring of new employees; creation or filling up of new positions; promotion or giving of salary increases, remuneration or privilege (Sec. 261 (g), OEC).

Construction of public works, delivery of materials for public works and issuance of treasury warrants or similar devices for a future undertaking chargeable against public funds (Sec. 261 (w), OEC).

Releases, disbursements or expenditures of public funds public works, social services and development (Sec. 261 (v), OEC)

Last day to furnish every registered voter with a Voter’s Information Sheet which contains the voter’s name, address, precinct, place where he is registered and simplified instructions as to casting of votes, an official sample ballot and a list of all registered national, provincial and city candidates to be voted for in the election (Sec. 1, RA 7904).

May 14, 2007 (MON) (ELECTION DAY)

Casting of Votes (Local) (7:00 a.m. to 3:00 p.m.)

Campaigning (Sec. 3, OEC)

Selling, furnishing, offering, buying, serving or taking intoxicating liquor (Sec. 261 (dd) (1), OEC)

Giving, accepting free transportation, food, drinks and things of value (Sec. 89, OEC)

Soliciting votes or undertaking any propaganda for or against any candidate or any political party within the polling place or within thirty (30) meters thereof (Sec. 261 (cc), OEC)

Voting more than once or in substitution of another (Sec. 261 (z) (2) and (3), OEC)

Holding of fairs, cockfights, boxing, horse races or similar sports (Sec 261 (dd), OEC)

Opening of booths or stalls for the sale, etc., of merchandise or refreshments within a radius of thirty meters from the polling place (Sec. 261 (dd), OEC)

 

Convening of the Municipal / City / Provincial and District Boards of Canvassers and Special Boards of Canvassers (SBOCs) (6:00 p.m. Philippine time).

 

May 15, 2007 (TUE) to June 13, 2007 (WED)

Filing of Sworn Statement of Election Contributions and Expenditures (Sec. 14, RA 7166)

 

This Resolution shall take effect seven (7) days after its publication in two (2) newspapers of general circulation in the Philippines.

The Education and Information Department shall cause the publication of this Resolution and shall furnish copies thereof to all Regional Election Directors, Provincial Election Supervisors, Election Officers and all Departments, Bureaus, Offices and Agencies deputized by the Commission, including the Department of Foreign Affairs and other government agencies maintaining offices abroad.
