1. REALTY; SALE; POWER OF ATTORNEY. — The documents copied in the opinion did not authorize the attorney in fact named therein to sell the land in question in this suit.
D E C I S I O N
WILLARD, J. :
The plaintiff, claiming to be owner of the lot and land in question, brought this action to recover its possession from the defendant, Montelibano. The latter, in his answer, alleged that he had bought the lot of the plaintiff through the latter’s duly authorized agent, Jose Felix Martinez, and the only question in the case is whether Martinez was authorized by Devesa to sell the land. Martinez himself testified that the only authority he had was found in two documents marked "Exhibit A" and "Exhibit I." Exhibit A is as follows:jgc:chanrobles.com.ph
"Sor. D. ANTONIO HERRERO.
"DISTINGUIDO AMIGO: Por esta carta autorizo a V. para que como abogado, gestione en nombre mio, cuantos asuntos e intereses tengan relacion conmigo, tanto judicial como extrajudicialmente, asi civiles como criminales y gubernativos, haga efectivas cuantas cantidades me correspondan, se posesione de los intereses y derechos que me pertenezcan, y trasija los pleitos en que tengo parte como demandante o demandado, bien anteriores a esta fecha, como los que V. promueva, para todo lo cual y demas asuntos de naturaleza analoga, le doy a V. el mas amplio poder, el cual efectividad dentro del Archipielago Filipino.
"Quedo de V. atento y servidor,

The authority given by this letter to Herrero was, with the consent in writting of the plaintiff, transferred to Martinez on the 20th of June, 1902. Exhibit I above referred to is as follows:jgc:chanrobles.com.ph
"MANILA, 30 de Agosto de 1902.
"Sr. D. JOSE F. MARTINEZ.
"MI DISTINGUIDO AMIGO Y ABOGADO: En mi poder obra una carta del Sr. Jayme de fecha 8 del correinte incluyendome una minuta de honorarios por valor de 2,300 pesos, mejicanos. No me ha extranado el envio de la cuenta, pues natural y logico es que le satisfaga lo que por mi haya trabajado; pero si, creo algo exagerada aquella minuta por y ello le ruego, que viendo por mis intereses desgraciadamante mermados, interceda para con dicho senor y le encarezca, se coloque en el justo medio que si asi lo hace presto le hare efectivo lo que importe.
"Deseo tambien vea de gestionar la venta de la hacienda Manapla y acelerar el cobro de las rentas de mis fincas; pues con tantas obligaciones por delante y sin un cuarto, la vida me va cansando y concluyo por desesperarme.
"Ha llegado a esta el vapor Taculin y no he recibido ninguana de Vd. pero desde luego le significo que no estoy conforme con el arriendo de mi finca ocupada por el cuartel americano en 20 dollars.
"Sin mas que desearle felix exito en el asunto que le encomiendo y en los que en esa dirige, con mil gracias por todo, sabe manda a su affimo. amigo y servidor.

The land referred to in this letter as the hacienda Manapla is not the land in controversy in this case.
Neither one of these documents authorized Martinez to sell the real estate in question, and the deed thereof which he made as attorney in fact for the plaintiff did not deprive the plaintiff of his ownership of the property.
The judgment of the court below is affirmed, with the costs of this instance against the Appellant. After the expiration of twenty days from the date hereof let judgment be entered in accordance herewith, and ten days thereafter let the case be remanded to the court below for proper action. So ordered.
