SYLLABUS


1. SENTENCIA; EJECUCION; DISCRECION DEL JUZGADO; "CERTIORARI." — El tribunal de origen, al ordenar la ejecucion de la sentencia, se fundo en que entre I. A. y su pupila, C. G.; existia la relacion fiduciaria de tutor a pupila; que I. A., al obrar como obro, violo sus deberes como tutor de C. G.; que habria necesidad de proceder a una particion de bienes entre los recurrentes y la administracion del intestado de C. G.; que estos procedimientos requeririan algun tiempo y que durante su pendencia los recurrente estarian naturalmente en posesion de los terrenos reclamados; que inclusive habria necesidad de enmendar la sentencia cuya ejecucion parcial se habia pedido. No consideramos como buenas tales razones. Entendemos que la facultad discrecional del Tribunal a quo debio haberse ejercitado en el sentido de mantener el status quo las partes; esto por un lado, y, por otro, alegase por los recurrentes que el intestado de C. G. es insolvente y que pudiendo ocurrir que los recurrente sean por lo menos considerados como poseedores de buena fe de los terrenos cuestionados, seria injusto obligar a dichos recurrente a entregarla enorme suma de P573,223.95, antes de que la decision del Tribunal a quo adquiera caracter final y definitivo. Opinamos, por consiguinete, que se esta en el caso en que debe mantenerse el status quo entre las partes y que, bajo las circunstancias expuestas por una y otro parte, dicho Tribunal obro con abuso de discrecion al ordenar la ejucucion parcial de la sentencia.


D E C I S I O N


HORRILLENO, M. :


Estos dos asuntos Nos. 47955 y 47993 se refieren, respectivamente, a una sola causa: la No. 9137 del Juzgado de Primera Instancia de Iloilo, intitulada Ricardo Carreon, como administrador del Intestado de Concepcion Gerona, contra Lucio Lacson, Mariano D. Arroyo y Jose Ma. Arroyo, demandados. Los fundamentos de uno y otro recurso son identicos; su objeto el mismo.

En la causa No. 9137 del Juzgado de Primera Instancia de Iloilo el objeto era reivindicar de los demandados, aqui recurrentes, los terrenos descritos en la demanda y el pago de daños y perjuicios que consisten en los productos de las propiedades en litigio, percibidos no solo por Ignacio Arroyo sino tambien por sus hijos, Jose Ma. Arroyo, ya difunto, y Mariano B. Arroyo. El asunto se fallo del recurrido Carreon en su concepto de administrador de los bienes del intestado de Concepcion Gerona. La parte dispositiva de la sentencia es como sigue:jgc:chanrobles.com.ph

"In view of the foregoing considerations, the court hereby renders judgment against the defendants and in favor of the plaintiff, in his capacity as Administrator of the Intestate Estate of Concepcion Gerona, as follows:jgc:chanrobles.com.ph

"(1) Declaring the estate of Concepcion Gerona entitled to the ownership of one-half pro indiviso of all the properties in question described in the body of this decision;

"(2) Sentencing the defendants Lucio Lacson, as Executor and legal representative of Ignacio Arroyo, Jose Ma. Arroyo, jr., as Administrator of Jose Ma. Arroyo and Mariano B. Arroyo to deliver to the plaintiff the possession of two-thirds and one-half pro-indiviso of all the properties in question located in the Provinces of Occidental Negros and Iloilo with the exception of the lots donated to the Municipality of Iloilo and to the Beaterio del Santisimo Rosario de Molo;

"(3) Sentencing the defendant Ignacio Arroyo, or his legal representative, to pay to the plaintiff the sum of P8,528.33 corresponding to the value of two thirds of the fruits received by him which pertain to the estate of Concepcion Gerona, for the period from 1895 to 1903;"

(4) Ordering the defendants Lucio Lacson, as Executor of Ignacio Arroyo, Jose Ma. Arroyo, jr., as Administrator of Jose Ma. Arroyo, and Mariano B. Arroyo to render an accounting of the fruits and products of all the properties in question which they may have received during the period from 1903 to 1922 and to deliver to the plaintiff, after such accounting, two-third (2/3) of one-half of said fruits and products;

"(5) Sentencing the defendants Lucio Lacson, as legal representative of Ignacio Arroyo, Jose Ma. Arroyo, jr., as Administrators and legal representative of Jose Ma. Arroyo, and Mariano B. Arroyo to pay to the plaintiff mancomun et in solidum the sum of two hundred three thousand six hundred forty-six pesos and thirty centavos (P203,646.30) which amount corresponds to two-third (2/3) of one-half of the rents received from the lands in question from 1922 to 1926;

"(6) Sentencing the defendants Lucio Lacson, as Administrator of Ignacio Arroyo, and Jose Ma. Arroyo, jr., as Administrator of Jose Ma. Arroyo, to pay the plaintiff, jointly and severally, the sum of three hundred ninety-one thousand eight hundred thirty pesos and thirty-one centavos (P391,830.31) equivalent to two-thirds (2/3) of one-half of the products and fruits corresponding to the years 1926 to 1937. The defendants may, however, deduct from this amount the sum of twenty-six thousand six hundred seventy-one pesos and eighty-one centavos (P26,671.81) equivalent to two-thirds (2/3) of one-half of the value of the improvements introduced and the amount of four thousand ninety- nine pesos and eighteen centavos (P4,099.18), which is two-thirds (2/3) of one-half of the amount paid for taxes for the properties in question.

"(7) Ordering the defendants Lucio Lacson as Executor of Ignacio Arroyo, and Jose Ma. Arroyo, jr., as Administrator and legal representative of Jose Ma. Arroyo, to render as accounting of the fruits and products they may have received from 1937 to the present time;

"(8) Sentencing Lucio Lacson, as Executor and Administrator of the defendant Ignacio Arroyo, to pay to the plaintiff, two-sixths (2/6) of the value of the lands donated to the Beaterio del Santisimo Rosario de Molo;

"(9) Sentencing the defendants Lucio Lacson, as Executor and Administrator of Ignacio Arroyo, to pay to the plaintiff, two-sixths (2/6) of the value of the properties donated to the Municipality of Iloilo; and

"(10) Sentencing the defendants, Lucio Lacson, as Executor of Ignacio Arroyo, Jose Ma. Arroyo, jr., as Administrator of Jose Ma. Arroyo, and Marino B. Arroyo, to pay the costs of civil case No. 9137."cralaw virtua1aw library

Notificados del fallo, los recurrentes presentaron una peticion de nueva vista, fundada en que la sentencia era contraria a la ley y al peso de las pruebas. La peticion fue denegada. Los recurrentes se excepcionaron contra el auto denegatorio, y dentro del plazo reglamentario presentaron un aviso de apelacion, fianza y expediente de apelacion. Pendiente de aprobacion dicho expediente de apelacion, el demandante en dicha causa No. 9137, y en estos recursos, una de los recurridos, fundando en que los demandados carecian de bienes suficientes para responder del paga de los daños y perjuicios a que fueron condenados; y en que la apelacio interpuesta era solo un tactica dilatoria por cuanto que existe res judicata en el asunto, pidio en dicho asunto No. 9137 la ejecucion de la sentencia. Los recurrentes se opusieron a la peticion, alegando que no habia buenas razones para estimar dicha peticion de ejecucion de sentencia. El Juzgado, sin embargo, accedio a lo pedido, en su autos de fecha 3 de octubre de 1940 en que se fijaba, ademas, la suma de P500,000 para la fianza que dichos recurrentes debian prestar si querian que se suspendiese la ejecucion. Estos pidieron que se reconsiderara el referido auto de 3 de octubre de 1940. Esta peticion fue desestimada. El Juzgado, sin embargo, en su auto de 30 de octubre de 1940, redujo la cuantia de la fianza de P500,000 a P400,000. De aqui la presentacion en este Tribunal de estos dos asuntos de certiorari.

Antes de pasar adelante, conviene hacer notar que la ejecucion de la sentencia ordenada por el Tribunal a quo es parcial; se refiere solamente a los daños a que fueron condenados los demandados y que ascienden a la suma de P573,223.95. Los recurrentes, como fundamento de sus recursos, alegan la falta de jurisdiccion del Tribunal de origen para fallar el asunto No. 9137, por haberse fundado en una prueba que no habia sido admitida como tal; el error del tribunal de origen de haber extendido a Jose Maria Arroyo la relacion fiduciaria entre Ignacio Arroyo y su pupila, Concepcion Gerona; el que los bienes cuya reivindicacion se pedia en la causa No. 9137, teniendo a su nombre Jose Ma. Arroyo un titulo Torrens sobre los terrenos en litigio; que no existe res judicata en dicho asunto; y que el tribunal de origen se excedio o abuso de sus facultades discrecionales al ordenar la ejecucion parcial de la sentencia. Tales son, en sustancia, los fundamentos en que se basan los recurrentes. Por su parte, el recurrido Carreon alega que existe res judicata en el asunto 137; que los recurrentes son insolventes; que el finando Don Ignacio Arroyo estuvo en posesion de los bienes controvertidos continuamente desde el año 1925 hasta la fecha de su muerte ocurrida el 8 de enero de 1935, aprovechandose ilegalmente de los frutos de los bienes; que habia entre Ignacio Arroyo y su pupila, la incapacitada Concepcion Gerona, la relacion fiduciaria de tutor a pupila; que dicho Ignacio Arroyo fraudulentamente desposeyo a su pupila de los bienes y a cuantos de esta pudieran derivar algun interes o titulo hereditario; que la ejecucion de la sentencia se refiere solo a los daños.

Como se habra notado las cuestiones que plantean tanto los recurrentes como el recurrido Carreon, son cuestiones que afectan, en su mayor parte, al fondo del asunto. Nos abstendremos de considerar tales cuestiones y nos limitaremos unicamente a la que a nuestro juicio debe atenderse y resolverse en estos recursos, a saber: si segun las circunstancias del caso, el Juzgado de Primera Instancia de Iloilo obro o no con abuso de sus facultades discrecionales que le confiere la Regla 39, seccion, 2, del nuevo reglamento de los Tribunales, y que dice asi:jgc:chanrobles.com.ph

"ART. 2. Discrecionalidad en la ejecucion. — A discrecion del Juzgado y fundada en buenas razones, que se expondran en una orden expecial y a mocion de la parte vencedora y con notificacion a la parte contraria, podra expedirse ejecucion antes de la expiracion del termino concedido para la apelacion. En el caso de que despues se presentara expediente de apelacion, la orden especial sera incluida en dicho expediente. La ejecucion expedida antes de la expiracion del termino concedido para la apelacion, podra suspenderse a la aprobacion por el Juzgado de una fianza de suspension de la sentencia, prestada por el apelante para responder del cumplimiento de la sentencia u orden apelada para el caso de que la misma fuere confirmada total o parcialmente."cralaw virtua1aw library

El unico punto, pues, que debe resolverse, es si existen o no buenas razones para ordenar la ejecucion de la sentencia en el tantas veces referido asunto No. 9137. El Tribunal a quo, en su auto de fecha 3 de octubre de 1940, cuya anulacion se pide, entre otras cosad, dice:jgc:chanrobles.com.ph

"The facts mentioned in the two preceding paragraphs, jointly or separately, are more than sufficient to convince the court that the plaintiff is entitled to, at lease, a partial execution of the decision rendered in this case, notwithstanding defendants’ appeal."cralaw virtua1aw library

Los hechos, por tanto, en que se baso el tribunal de origen se hallen en los dos parrafos precedentes al acotado:jgc:chanrobles.com.ph

"It must be borne in mind that the deceased Ignacio Arroyo — who according to the Supreme Court had committed a serious breach of trust against his ward, the mentally incompetent Concepcion Gerona — and after him his heirs, successors and legal representatives, have been in possession of the lawful share of the said incompetent for the last 27 years at least, enjoying during this long period of time all the benefits yearly derived therefrom.

"Furthermore, the present being an action for the recovery of the ownership and possession of the real properties in question, and not for the partition thereof, the court entertains a serious doubt as to the propriety of carrying into execution at this stage of the proceedings the second paragraph of the dispositive part of the decision in question which sentences the defendants to deliver to the plaintiff the possession of two-thirds of one-half pro indiviso of all the properties in question except the lots donated to the old municipality of Iloilo and to the Beaterio del Santisimo Rosario de Molo. To effect an actual division and to have the share of the deceased incompetent Concepcion Gerona delivered to the plaintiff, her legal representative, it would be necessary either to amend the decision heretofore rendered by providing therein for whatever may be needed — such as the appointment of commissioners of parties, or to commence a separate action for partition. Even if a motion to amend the decision were filed by the plaintiff, this court would not now feel like granting the same, for obvious reasons. The remedy should be obtained from the appellate courts. Upon the other hand, the commencement of a separate action for partition would inevitably mean that the defendants would have to stay in possession of the portion that should be delivered to the plaintiff, not only during the pendency of the appeal sought to be interposed against the decision rendered herein but also during the pendency of the partition proceedings."cralaw virtua1aw library

Brevemente expuesto, dicho Tribunal de origen, al ordenar la ejecucion de la sentencia, se fundo en que entre Ignacio Arroyo y su pupila, Concepcion Gerona, existia la relacion fiduciaria de tutor a pupila; que Ignacio Arroyo, al obrar como obro, violo sus deberes como tutor de Concepcion Gerona; que habria necesidad de proceder a una particion de bienes entre los recurrente y la administracion del intestado de Concepcion Gerona; que estos procedimientos requeririan algun tiempo y que durante su pendencia los recurrentes entarian naturalmente en posesion de los terrenos reclamados; que inclusive habria necesidad de enmendar la sentencia cuya ejecucion parcial se habia pedido. No consideramos como buenas tales razones. Entendemos que la facultad discrecional del tribunal a quo debio haberse ejecritado en el sentido de mantener al status quo entre las partes; esto por en lado, y, por, otro, alegase por los recurrentes que el intestado de Concepcion Gerona es insolvente y que pudiendo ocurrir que los recurrentes sean por los recurrentes que el intestado de Concepcion Gerona es insolvente y que pudiendo ocurrir que los recurrentes sean por lo menos considerados como poseedores de buena fe de os terrenos cuestionados, seria injusto obligar a dichos recurrentes a entregar la enorme suma de P573,223.95, antes de que la decision del Tribunal a quo adquiera caracter final y definitivo. Opinamos, por consiguiente, que se esta en el caso en que debe mantenerse el status quo entre las partes y que, bajo las circunstancias expuestas por una y otra parte, dicho Tribunal obro con abuso de discrecion al ordenar la ejecucion parcial de la sentencia.

Por tanto, declaramos que el auto del 3 de octubre de 1940, habiendo sido dictado con abuso de discrecion, es nulo y sin ningun efecto. No se hace especial pronunciamiento en cuanto a las costas. Asi se ordena.

I concur in the majority opinion penned by Mr. Justice Horrilleno and desire to add the following observations:chanrob1es virtual 1aw library

Respondent Carreon’s allegation in the court below that the herein petitioners are insolvent was no supported by any affidavit; nor was the motion verified. As a matter of fact that point was nor relied upon by the respondent judge in ordering the execution of the judgment pending appeal.

It is not seriously contended that the proposed appeal is frivolous. As I understand it, the reason given by the respondent judge is, that the herein petitioners (defendants below) have been enjoying the property in litigation for a long period of time and it will take a long time yet before its restoration to the respondent Carreon could be effected.

But whatever weight may be given to such consideration is entirely neutralized by the undisputed fact that the respondent Carreon as administrator of the intestate estate of Concepcion Gerona is insolvent and has litigated as a pauper in the court below. The attorneys for the respondents in their answer pleaded:jgc:chanrobles.com.ph

"Por lo demas, Ricardo Carreon en su capacidad como administrador del abintestato de Concepcion Gerona, es un funcionario judicial y en las actuaciones de aquel el Juzgado de Primera Instancia de Iloilo, donde esta pendiente dicho abintestato, tiene absoluto control. Ricardo Carreon no podra hacer lo que quisiere del dinero, producto de la ejecucion, toda vez que por ley tiene que dar cuenta al Juzgado de cualquiera disposicion que haga de los fondos del intestado. Ademas esta sujeto a una fianza segun sea el caso.

"Teniendo todo esto en cuenta, es facil ver que los recurrentes al presentar un escrito al efecto en el expediente del abintestato de Concepcion Gerona, podrian evitar que el administrador, Ricardo Carreon, pueda disponer del dinero que tenga en su poder de la ejecucion de la decision de la causa referida mientras este pendiente la apelacion interpuesta por los aqui recurrentes.

"La insolvencia de Ricardo Carreon, por tanto, no debe servir de obice a la ejecucion de la decision Anexo A."cralaw virtua1aw library

If, after all, the proceeds of the execution sale would have to be kept intact pending appeal, as counsel for respondents suggest, there seems to be no use nor justification for the premature execution.

It results then, that there is no valid reason for the order in question.

A mi juicio, el Juzgado inferior no ha cometido ningun abuso de discrecion. Ordeno la ejecucion de la sentencia en virtud de buenas razones que se especifican en la orden. Si esas razones son no de peso suficiente, es cuestion que debe determinarse por el Juzgado inferior. La discrecion que debe ejercitarse en tales casos no es la nuestra sino la del Juzgado sentenciador. No podemos intervenir aunque el Juzgado inferior yerre en el ejecicio de esa discrecion. Los unicos dos casos en que nuestra intervencion esta autorizada por la ley, es 1. �, cuando el Juzgado sentenciador comete abuso de discrecion, o 2. �, cuando, despues de ordenada la ejecucion de la sentencia, las circunstancias cambian de tal manera que se hace necesaria la intervencion de este Tribunal. (Calvo v. Gutierrez, 4 Phil., 203; Case v. Metropole Hotel & Restaurant, 5 Phil., 49; Gamay v. Gutierrez David, 48 Phil., 768.)

Repito que el Juzgado inferior no ha cometido abuso de discrecion. Hay una inmenza diferencia entre un simple error de juicio y un abuso de discrecion. En repetidas ocasiones hemos definido lo que es un abuso de discrecion, para distinguirlo de un simple error de juicio. En el asunto de Abad Santos v. Province of Tarlac (38 Off. Gaz., 830), se dijo que "abuse of discretion implies such capricious and whimsical exercise of judgment as is equivalent to lack of jurisdiction." En el asunto de Tavera-Luna, Inc. v. Nable (38 Off. Gaz., 62), se declaro que hay abuso de discrecion "where the power is exercised in an arbitrary or despotic manner by reason or passion or personal hostility, and it must be so patent and gross as to amount to an evasion of postive duty or to a virtual refusal to perform the duty enjoined or to act at all in contemplation of law." Y estas doctrinas fueron ratificadas en el asunto de Alafriz v. Nable, G. R. No. 47780, en que la decision fue promulgada el 10 de junio de 1941.

En el caso presente la mayoria no declara ni puede declarar que el Juzgado de Primera Instancia de Iloilo ha abrado caprichosa y arbitrariamente y de una manera apesionada y despotica. Por el contrario, el Juzgado inferior ha obrado despues de una acabada consideracion de todas las circunstancias del caso, y si ha ordenado la ejecucion de la sentencia, lo hizo en virtud de razones que no son infundadas.

Por estas consideraciones, disiento de la decision de la mayoria.
