SYLLABUS


1. ADMINISTRATIVE LAW; MUNICIPAL OFFICIALS; PROHIBITION AGAINST HAVING INTEREST IN MUNICIPAL CONTRACTS OR PURCHASE OF REAL ESTATE BELONGING TO MUNICIPALITY INCLUDES STEPS TAKEN TO PERFECT AND CONSUMMATE SUCH CONTRACTS. — Just as under the Revised Penal Code the transgressor of the law may be convicted not only when the crime is consummated but also when it is frustrated or attempted, so also under the provisions of sections 2176 and 2761 of the Revised Administrative Code, steps taken by a municipal official which would lead to bring about the perfection, consummation and execution of a municipal contract or of a purchase of real estate belonging to the municipality, in which contract or purchase said official possesses direct or indirect pecuniary interest, are included in the prohibition.

2. ID.; ID.; ID.; PHRASE "PURCHASE OF REAL ESTATE INCLUDES "EXCHANGE" OF PROPERTIES. — Although section 2176 of the Revised Administrative Code does not use the term "exchange" yet it is encompassed in the term "municipal contract" and in the term "purchase of any real estate or any other property belonging thereto" found in section 2761 of the same Code, for exchange is equivalent to purchase, the only difference being that instead of paying money for the price or consideration property is given lieu thereof.


D E C I S I O N


PADILLA, J.:


The petitioner is charged with a violation of section 2761 in connection with section 2176 of the Revised Administrative Code, as amended by Republic Act No. 383, in an information which reads as follows:chanrob1es virtual 1aw library

The undersigned Provincial Fiscal accuses the above-named defendant for violation of section 2761 in connection with section 2176, Administrative Code, as amended by Republic Act No. 383, committed as follows:chanrob1es virtual 1aw library

That on or about June 9, 1949, in the municipality of Miagao, province of Iloilo, Philippines, and within the jurisdiction of this Court, the said accused, being a member of the Municipal Council of Miagao, did, then and there willfully; unlawfully and feloniously procure and work and take direct interest in the approval and perfection of the contract of exchange of a piece of land belonging to the municipality of Miagao, for two (2) parcels of land belonging to her husband, Ignacio Navarra, (in) which contract of exchange said accused possessed directly or indirectly pecuniary interest.

The case has been brought by a petition for a writ of certiorari to review the judgment of the Court of Appeals which affirmed that of the Court of First Instance of Iloilo. The dispositive part of the judgment of the trial court is —

Por todas las consideraciones arriba expuestas, el juzgado llega a la conclusion de que la acusada Rosario Monteclaro, concejal electiva del municipio de Miagao de esta provincia de Iloilo, ha infringido fuera de toda duda razonable los articulos 2176 y 2761 del Codigo Administrativo Revisado, segun esta el primero enmendado por la Ley No. 383 de la Republica. El hecho criminoso se ha desarrolado durante el periodo de tiempo comprendido desde en o hacia el 1 noviembre 1948 (Exhibit E) hasta en o hacia el 21 febrero 1950 (Exhibit N), es decir, dentro del imperio del repetido articulo 2176 del Codigo Administrativo Revisado, segun esta enmendado por la Ley No. 383 de la Republica, ley esta No. 383 que entro en vigor el 17 junio 1949.

Hay una circunstancia que en cierto modo mitiga la culpabilidad de la acusada, y es, que su marido Ignacio N. Navarra esta enfermo de paralisis.

Por tanto, hallando a la acusada Rosario Monteclaro de Navarra culpable del delito querellado, se le condena a sufrir 6 meses de prision y a pagar las costas de este juicio.

Se recomienda clemencia ejecutiva de su Excelencia, el Presidente de Filipinas, despues de que la acusada haya extinguido un mes de su condena.

Que la acusada Rosario Monteclaro es concejal electiva del municipio de Miagao de esta provincia de Iloilo desde el año 1948 hasta el presente. Esta casada con Ignacio N. Navarra desde el año 1929;

Que el municipio de Miagao es dueño de una parcela de terreno residencial y comercial, de primera clase, situada en la esquina de las calles Osmeña y Zulueta, de una cabida de 704 metros cuadra-amillarada en P420 (Exhibit A);

Que desde el año 1945 la acusada Rosario Monteclaro y su esposo Ignacio N. Navarra tienen edificada su casa-residencia, de materiales fuertes, en el terreno solar mencionado en el parrafo anterior, por cuyo uso pagaban un alquiler de P30 al año hasta el 5 abril 1949, en que Ignacio N. Navarra permuto esta parcela de terreno con otra suya situada en el barrio de Igtuba del referido municipio de Miagao;

Que ese terreno de Igtuba, de Ignacio N. Navarra, es de 4,134 metros cuadrados, agricola, amillarado con sus mejoras en P160 (Exhibit K). Este terreno lo necesita el municipio de Miagao para la mejora de la High School local. Es un bien parafernal de Ignacio N. Navarra;

Que Ignacio N. Navarra era asimismo dueño y poseedor de otro terreno residencial, situado en la calle Santo Tomas del arrabal de Ubos del municipio de Miagao, de 500 metros cuadrados y amillarado en P200 (Exhibit L), terreno que el municipio de Miagao necesita tambien para fines de escuela elemental. Es un bien privativo de Ignacio N. Navarra, adquirido por este en donacion de Sinforosa Monteclaro, durante su matrimonio con la aqui acusada;

Que asi las cosas, en carta de 1 noviembre 1948 Ignacio N. Navarra propuso al Consejo Municipal de Miagao la permuta de su terreno de Igtuba con el residencial de dicho municipio en el que el y su esposa la acusada tenian como se ha dicho edificada su casa vivienda (Exhibit E);

Que por Resolucion No. 10 de 5 abril 1949 el Consejo municipal de Miagao aprobo por mayoria de votos dicha permuta, sobre cuya Resolucion No. 10 la acusada Rosario Monteclaro sa abstuvo de votar (Exhibit F);

Que en 7 abril 1949 y por comunicacion de esa fecha dirigida a la Junta Provincial (Exhibit M), el alcalde Paulino M Nico, de Miagao, registro su protesta contra la Resolucion No. 10 que aprobaba la permuta, alegando entre otras razones la de que, primero, el titulo de Ignacio N. Navarra al terreno de Igtuba era dudoso, porque estaba contendido por los herederos de Vicente Quillantang y podria por ello envolver en litigio al municipio de Miagao, y segundo, porque habia gran desproporcion, desfavorable al municipio de Miagao, entre el valor del terreno de esto, ocupado por la casa vivienda de la acusada y su esposo, y el terreno de Igtuba, de Navarra;

Que mientras esa protesta del alcalde Nico se hallaba en tramite en la Junta Provincial, Ignacio N. Navarra, en carta de 19 mayo 1949 (Exhibit G) propuso al Consejo Municipal de Miagao que para obviar la oposicion del alcalde Nico el, Ignacio N. Navarra, cederia al municipio como consideracion adicional de la permuta su terreno de 500 metros cuadrados de Ubos;

Que esa carta Exhibit C fue entregada por la acusada Rosario Monteclaro al secretario municipal de Miagao, Bienvenido Monteclaro, en la sesion del Consejo del dia 9 junio 1949. Bienvenido Monteclaro paso la carta al vice-alcalde y alcalde interino Jose Nobelza y esta le sometio al Consejo. Estaba entonces presente en la sesion del Consejo la acusada Rosario Monteclaro, la cual expuso a los presentes que con esa adicion del terreno de Ubos ella creia que quedaba satisfecha y zanjada la oposicion del alcalde Nico. Esa manifestacion de la acusada fue oida, entre otros, por el secretario municipal Bienvenido Monteclaro y el concejal Victorino Fermindosa. El Consejo resolvio autorizar el alcalde para celebrar el contrato de permuta con Ignacio N. Navarra, del terreno del municipio en la esquina de las calles Osmeña y Zulueta con los ya dichos dos terrenos de Igtuba y Ubos de Ignacio N. Navarra, resolucion en la que la acusada Rosario Monteclaro se abstuvo de votar (Exhibit H-1);

Que como efecto de lo expuesto en el parrafo anterior en 9 junio 1949 y ante la fe del notario publico Pablo Hinolan de esta provincia de Iloilo se otrogo por el vice-alcalde interino Jose Nobleza la escrita publico de permuta de las ya dichas tres parcelas de terreno entre el municipio de Miagao e Ignacio N. Navarra (Exhibit B);

Que en 14 septiembre 1949 Ignacio N. Navarra presto a favor del municipio de Miagao fianza de P1,000 (Exbibit P) en garantia de la permuta;

Que despues de todo lo arriba expuesto, la acusada Rosario Monteclaro hizo "lobbying", como se dice en ingles, viendose, como se vio con el tesorero municipal Joaquin Tacsagon, el delegado de la tesoreria provincial Jesus Nievales, el auditor provincial y el tasador provincial Elias L. Villaluna, interesandose de estos funcionarios que le asesorasen sobre mas conveniente para el pronto despacho y realizacion de la permuta, pero todo fue inutil, porque debido a la protesta del alcalde Nico las oficinas del caso no daban su conformidad, por lo que la acusada Rosario Monteclaro propuso pagar la suma adicional de P591 que la Junta Provincial fijada como la diferencia entre el valor del terreno del municipio y el de los dos que en permuta ofrecia Ignacio N. Navarra, propuesta que el tesorero provincial instruyo al tesorero municipal de Miagao no aceptar, en telegrama de 26 enero 1951 (Exhibit 3);

Que el asunto de la permuta paso por fin a accion de la Secretaria del Interior, en Manila, a cuya ciudad y oficina se fue la acusada Rosario Monteclaro provista de la escritura de poder especial, Exhibit N, que le habia dado su esposo Ignacio N. Navarra el 21 febrero 1950 y en la que entre otras cosas le constituyo "as my true and lawful attorney-in-fact, for me and in my name, place and stead, to represent our right, interest and to sign any paper referring to the exchange of our two parcels of land with the land of the municipality of Miagao, Iloilo, to appear before any authority to work for the approval of the contract of exchange of the said lots." Y con ese poder la acusada Rosario Monteclaro gestiono en la Secretaria del Interior el pronto despacho de la permuta, cuya aprobacion final no esta acordada hasta ahora por dicha Superioridad; y.

Que en vista de toda la actuacion arriba expuesta de la acusada Rosario Monteclaro, el alcalde Nico instituyo el 6 febrero 1951 en el juzgado de pas de Miagao denuncia contra Rosario Monteclaro acusandole de haber infringido el articulo 2761 en relacion con el 2176 del Codigo Administrativo Revisado, segun esta el ultimo enmendado por la Ley No. 383 de la Republica, denuncia que dio inicio a la presente accion y de la que la acusada tuvo conocimiento a tiempo tanto que preparo la correspondiente fianza de libertad provisional, si bien no fue arrestada sino el 27 de aquel mes de febrero, de noche, y quedo detenida en la casa municipal durante una hora, en que perfecciono la fianza de libertad provisional, haciendola firmar por el fiador que faltaba.

Y en esta instancia la acusada Rosario Monteclaro se defiende diciendo que la misma es resultado del odio, resentimiento y venganza del alcalde Nico por haber sido ella una de los que con el vice-alcalde Jose Nobleza y los concejales Juan Monteclaro, Gecre A. Legaspi y Julian Paraiso le acusaron administrativamente ante el Presidente de Filipinas por mala conducta oficial, en denuncia de 30 mayo 1949, Exhibit 13, denuncia que investigada por la Junta Provincial recayo en 8 mayo 1950 resolucion condenatoria contra el alcalde Nico de tres meses de suspension, Exhibit 14, diciplina que fue reducida a quince dias de suspencion sin sueldo, por resolucion del Secretario del Interior fechada 19 diciembre 1950, Exhibit 15.

The facts disputed by the appellant upon which the Court of Appeals made express findings are unimportant and would not affect or alter the pronouncements of that Court. That the petitioner, who was a councilor of the municipality of Miagao, province of Iloilo, was interested in the exchange of the lot owned by the municipality of which she was a councilor, on which she and her husband Ignacio N. Navarra, as lessees, had built a house and for which they were paying to the municipality of Miagao a yearly rental of P30, for two lots owned by her husband, one occupied and used by the Miagao Regional High School and the other occupied and used by the municipal elementary school, can hardly be disputed. By acquiring said municipal lot the petitioner and her husband would save at least the rental paid by them to the municipality. It is true that the saving of the yearly rental for the lease of the lot belonging to the municipality would be offset by the rental the municipality might be required to pay (the municipality is not paying any rent for the two lots) for the lease or occupation or use of the two lots belonging to the petitioner’s husband. Nevertheless, the prohibition of the law does not require that the contract of exchange must result in an economic or pecuniary advantage to the municipal official. It is enough that the latter be pecuniary interested in the municipal contract. The argument that if the lot owned by the municipality be devoted to public use the exchange would be null and void, and that for that reason the petitioner cannot be deemed guilty of having a pecuniary interest in an exchange which is null and void, is without merit, because at the time of the exchange the lot belonging to the municipality was not devoted to public use or purpose. And the contention that the exchange of the lot belonging to the husband of the petitioner occupied and used by the Miagao Regional High School located in Igtuba not being the concern of the municipality is null and void may be correct, but that fact does not divest the lot owned by the municipality on which the petitioner and her husband had erected a house of its character as property of the municipality. True, section 2176 of the Revised Administrative Code does not use the term "exchange" but it is encompassed in the term "municipal contract" and in the term "purchase of any real estate or any other property belonging thereto" found in section 2761 of the same Code, for exchange is equivalent to purchase, the only difference being that instead of paying money for the price or consideration property is given in lieu thereof.

The petitioner argues that to commit a violation of the provisions of the Revised Administrative Code charged against her the exchange must be consummated. The provisions of the Revised Administrative Code charged to have been violated by the petitioner do not require that the contract be approved by the provincial governor as required in section 2196 of the same Code. The last cited section provides for the execution of deeds conveying municipal real property or any interest therein by the mayor upon resolution of the council and requires the approval of the provincial governor for its effectivity. But it does not mean that if the deed is not approved by the provincial governor the prohibition in sections 2176 and 2761 referred to may not be violated. Just as under the Revised Penal Code the transgressor of the law may be convicted not only when the crime is consummated but also when it is frustrated or attempted, so also under the provisions referred to, steps taken by a municipal official which would lead to bring about the perfection, consummation and execution of a municipal contract or of a purchase of real estate belonging to the municipality are included in the prohibition. The provisions of sections 2176 and 2761 of the Revised Administrative Code are intended to deter and prevent municipal officials from having an interest in any municipal contract or in the purchase of any real estate belonging to the municipality because of the influence or pressure that may be exerted or brought to bear upon the other Municipal officials to consent and approve such contract or purchase of real estate belonging to the municipality. If such provisions are to be construed as to prohibit and punish municipal officials who have or possess pecuniary interest, directly or indirectly, only in a consummated municipal contract or in a consummated purchase of any real estate belonging to the municipality, then the purpose and aim of the prohibition would not be realized and attained.

The judgment under review is affirmed, with costs against the petitioner.
