EXECUTIVE ORDER NO. 250-A -
AMENDING EXECUTIVE ORDER NO. 250 DATED 2 JUNE 1995 IMPLEMENTING THE
RATIONALIZATION OF DUTY FREE STORES/OUTLETS AND THEIR OPERATIONS IN THE
PHILIPPINES PURSUANT TO EO 140 AND FOR OTHER PURPOSES

| WHEREAS, under Sec. 4 (f) of RA
6768, balikbayans, as defined therein, are entitled to buy one (1) item
of every product of non-consumables, whose selling price exceeds Two
Hundred United States Dollars (US $200.00); WHEREAS, balikbayans and overseas contract workers are clamoring for their entitlement to buy such duty free imported heavy durables; NOW, THEREFORE, I, FIDEL V. RAMOS, President of the Philippines, by virtue of the powers vested in me by law, do hereby order: SECTION 1. Section 5 of Executive Order No. 250 dated 2 June 1995 is hereby amended to read as follows: “SECTION
5. Allowable Items in duty free shops. — The range of
items to be sold by duty free stores/outlets operated by Duty Free
Philippines outside of special economic zones/freeports established
pursuant to RA Nos. 7227 and 7916 shall henceforth be limited to
consumables, light durables, television sets of sizes not manufactured
in the Philippines and locally manufactured heavy durables.
Imported heavy durables carried by duty free stores/outlets operated in the country’ international ports of entry and special economic zones and freeports shall only be sold to balikbayans, overseas contract workers and residents of the secured area of the special economic zones and/or freeports. In the availment of this privilege, the following shall be presented as proof of entitlement. a.
Filipino citizen who has been continuously out of the country for at
least one (1) year from date of last departure:
1.
Philippine Passport showing date of last departure.
b. Foreign
passport holder:1.
Passport and any one of the following:
c. Filipino
overseas contract worker:—
Old Philippine passport
— Foreign naturalization papers to show former Philippine citizenship — Certification from adopted country 1.
Passport and any one of the following:
Family members of the balikbayan
who are travelling with the balikbayan should present:—
POEA approved contract of employment
— Seaman’s Service Record Book— Certificate of employment by the foreign employer — Certificate of employment by the Philippine Embassy/Consulate — Prior year’s income tax return to prove gainful employment abroad 1.
Passport and any one of the following:
—
Birth certificate, in the case of children
— Marriage certificate, in the case of the spouse — Adoption papers, in the case of legally adopted children.” SECTION 2. This Executive Order shall take effect immediately. DONE in the City of Manila, this 22nd day of December in the year of Our Lord, Nineteen Hundred and Ninety-Five. |
