SUPPLEMENT TO MEMORANDUM
CIRCULAR NO. 3 DATED 14 MARCH 1978.
It has been
observed
that, of late, an increasing number of subpoenas have been sent by the
various Courts to members of the Diplomatic Corps and non-diplomatic
personnel
of the different embassies. Relative thereto, the Director General of
Protocol
of the Department of Foreign Affairs, Manila, has formally requested
this
Court that thereafter, when personnel of the embassies or consulates in
Manila are parties to any case pending in Court, a brief summary of the
facts of the said case be attached to any writ of process that may be
issued
and delivered in connection therewith, as a means of enabling the
Department
of Foreign Affairs to act properly thereon.
For this purpose,
and as an adjunct to Memorandum
Circular No. 3, dated March 14, 1978, of this Court, which treats
of
substantially similar matter, you are hereby advised that henceforth,
any
Court process or writ issued in connection with any case involving
either
foreign governments or agencies or members of the Diplomatic Corps and
non-diplomatic personnel of the embassies or consulates should be
forwarded
to the Department of Foreign Affairs, accompanied by a brief summary of
the facts involved therein.
Strict compliance
herewith is enjoined.
