PRESIDENTIAL DECREE NO. 1405
PRESIDENTIAL DECREE NO. 1405 -
CONVERTING THE BUDGET COMMISSION AND THE NATIONAL SCIENCE DEVELOPMENT
BOARD INTO MINISTRIES

WHEREAS,
the Philippines is undergoing a transition from a presidential to a
parliamentary form of government;chanroblesvirtualawlibrary
WHEREAS, this situation requires some adaptive changes in the structure
of government; and
WHEREAS, for this purpose, it is necessary to convert appropriate
agencies into ministries. chanroblesvirtualawlibrary
NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines,
by virtue of the powers vested in me by the Constitution, do hereby
order and decree:cralaw:red
Section 1. The Budget Commission is hereby converted
into the Ministry of the Budget which shall be under the Office of the
President/Prime Minister, and the head thereof shall have the rank,
status and qualifications of a Minister and be a member of the Cabinet.
Section 2. The National Science Development Board is
hereby converted into a ministry with the same name, and the head
thereof shall have the rank, status and qualifications of a Minister
and be a member of the Cabinet.
Section 3. Except as above provided, the present
organization of the above agencies shall remain the same, unless
otherwise changed by law. chanroblesvirtualawlibrary
Section 4. Should any provision of this Decree or any
part thereof be declared unconstitutional, the remaining provisions or
parts thereof shall continue to be valid and binding.
Section 5. All laws, decrees, executive orders, rules
and regulations which are inconsistent with this Decree are hereby
repealed, altered or modified accordingly.
Section 6. This Decree shall take effect immediately.
DONE in the City of Manila,
this 11th day of June, in the year of Our Lord, nineteen hundred and
seventy-eight.
