PRESIDENTIAL DECREE NO. 635 -
AMENDING Section ONE HUNDRED TWELVE OF COMMONWEALTH ACT NUMBERED ONE
HUNDRED FORTY-ONE, AS AMENDED, OTHERWISE KNOWN AS THE PUBLIC LAND LAW

| WHEREAS,
the infrastructure program of the Government has been adopted primarily
to hasten the economic development of the country; WHEREAS, to carry out this program more effectively and to cope with the demands of the ever growing traffic volume, advance planning and programming for wider roads must be made; WHEREAS, in order to attain this objective, and to minimize to a great extent the financial burden on the part of the Government in acquiring the needed right-of-way for its public works projects, it is necessary to amend further section 112 of Commonwealth Act No. 141, as amended; NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers in me vested by the Constitution, do hereby decree and order as follows: Section 1. Section 112 of Republic Act No. 141, as amended, is hereby amended to read as follows: "Sec. 112. Said land shall further be subject to a right-of-way not exceeding sixty (60) meters in width for public highways, railroads, irrigation ditches, aqueducts, telegraph and telephone lines, and similar works as the Government or any public or quasi-public service or enterprise, including mining or forest concessionaires, may reasonably require for carrying on their business, with damages for the improvements only." Section 2. This Decree shall take effect immediately. All acts inconsistent with this Decree are hereby repealed or modified accordingly. DONE in the City of Manila, this 7th day of January, in the year of Our Lord, nineteen hundred and seventy-five. |
