FURTHER AMENDING THE PROVISIONS OF PRESIDENTIAL DECREE NUMBER FOUR
HUNDRED FIFTY-EIGHT, AS AMENDED, TO CREATE A PLANNING AND PROJECT
DEVELOPMENT OFFICE IN THE DEPARTMENT OF PUBLIC HIGHWAYS

WHEREAS,
under Section Two of Presidential Decree No. 458, as amended, it was
provided that the Department of Public Highways shall be made up of the
immediate Office of the Secretary, the Planning Service, the
Administrative Service, the Financial and Management Service and the
Special Projects Service including three bureaus, namely: (a) the
Bureau of Construction and Maintenance, (b) the Bureau of Equipment,
(c) the Bureau of Barangay Roads, and the Regional and District Offices;chanroblesvirtualawlibrary
WHEREAS, Section Nine of Presidential Decree No. 458 provides that the
functions and composition of the Planning Service, the Administrative
Service and Financial Management Service shall be in accordance with
those prescribed under Chapter 1, Part II of the Integrated
Reorganization Plan; chanroblesvirtualawlibrary
WHEREAS, The Department of Public Highways is involved in all sectors
of development wherein highway andrport infrastructure support is a
necessity;chanroblesvirtualawlibrary
WHEREAS, the present concept of development planning of the government
which consider economic, social and environmental aspects, necessitates
the expansion of the planning activities of the Department of Public
Highways in order to be responsive to the demands for the overall
development;chanroblesvirtualawlibrary
WHEREAS, there is a need to undertake a study and evaluation of all
highway andrport projects as to their economic and technical
feasibilities to adequately meet the transport requirements of the
growing economy;chanroblesvirtualawlibrary
WHEREAS, in view of the more comprehensive and exhaustive planning,
programming and research activities of the Department of Public
Highways, there is a need to expand its present Planning Service.
NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines,
by virtue of the powers in me vested by the Constitution, do hereby
decree and order; chanroblesvirtualawlibrary
Section 1. The provision of Section Two of
Presidential Decree No. 458, as amended, is hereby further amended to
read as follows:cralaw:red
"Sec. 2. Organization of the Department of Public
Highways. — The Department of Public Highways, hereinafter called the
Department shall be composed of a Department Proper made up of the
immediate Office of the Secretary, the Planning and Project Development
Office, the Administrative Service, the Financial and Management
Service, the Project Execution Service, the Legal Service and the
Special Projects Service, three Bureaus; namely: (a) the Bureau of
Construction and Maintenance, (b) the Bureau of Equipment, (c) the
Bureau of Barangay Roads, and the Regional and District Offices."
Section 2. The Planning and Project Development
Office shall be headed by a Director and Assistant Director both of
whom shall be appointed by the President upon recommendation of the
Secretary of Public Highways. chanroblesvirtualawlibrary
Section 3. This Decree shall take effect immediately.
