REPUBLIC ACT NO. 3110 - AN ACT
AMENDING CERTAIN SECTION OF REPUBLIC ACT NUMBERED TWENTY-THREE HUNDRED
EIGHTY-FOUR, ENTITLED "AN ACT GRANTING TO DANCAR ELECTRIC COMPANY A
FRANCHISE TO CONSTRUCT, OPERATE AND MAINTAIN ELECTRIC LIGHT, HEAT AND
POWER SYSTEMS IN THE MUNICIPALITIES OF DANAO, CARMEN AND CATMON, ALL IN
THE PROVINCE OF CEBU, AND AN ICE PLANT IN THE MUNICIPALITY OF DANAO,
PROVINCE OF CEBU, AND TO DISTRIBUTE AND SELL LIGHT, HEAT AND/OR POWER
IN THE SAID MUNICIPALITIES AND TO DISTRIBUTE AND SELL ICE IN THE WHOLE
PROVINCE OF CEBU"

| Section 1. Section one of
Republic Act Numbered Twenty-Three Hundred Eighty-Four is hereby
amended to read as follows: "Section
1. Subject to the terms and conditions established in
this Act there is granted to Dancar Electric and Ice Company,
hereinafter called the grantee, for a period of forty-five years from
the approval of this Act, the right, privilege and authority to
construct, maintain and operate an electric light, heat and power
system for the purpose of generating and distributing electric light,
heat, and/or power for sale within the Municipalities of Danao, Carmen
and Catmon, all in the Province of Cebu, and to construct, operate and
maintain an ice plant in the Municipality of Danao, for the purpose of
manufacturing and distributing ice in the Cities of Cebu and Toledo and
in the whole Province of Cebu, except the municipalities comprised in
the Fourth Representative District of Cebu, and to construct, operate
and maintain cold storage in the Municipality of Danao in the Cities of
Cebu and Toledo, and in the other municipalities in the Province of
Cebu, except the municipalities comprised in the Fourth Representative
District of Cebu, for the purpose of supplying cold storage therein and
to charge and collect a schedule of prices and rates for the ice and
cold storage so furnished, which schedule of prices and rates shall at
all times be subject to regulation by the Public Service Commission."
Sec. 2. Section three of the same Act is hereby amended to read as follows: "Sec.
3. The grantee shall manufacture and supply ice
within a minimum daily capacity of twenty tons."
Sec. 3. Section six of the same Act is hereby amended to read as follows: "Sec.
6. This franchise is granted subject to the
provisions of Commonwealth Act Numbered One hundred forty-six, as
amended, only with respect to the fixing of rates, and with the
understanding and upon the condition that it shall be subject to
amendment, alteration, or repeal by the Congress of the Philippines
when public interest so requires."
Sec. 4. The title of the same Act is hereby amended to read as follows: "An
Act granting to Dancar Electric and Ice Company a franchise to
construct, operate and maintain electric light, heat and power systems
in the municipalities of Danao, Carmen and Catmon, all in the Province
of Cebu, and an ice plant in the Municipality of Danao, Province of
Cebu, and to distribute and sell light, heat and/or power in the said
municipalities and to distribute and sell ice in the Cities of Cebu and
Toledo, and in the whole Province of Cebu, except the municipalities
comprised in the Fourth Representative District of Cebu, and to
construct, operate and maintain cold storage in the Municipality of
Danao, in the Cities of Toledo and Cebu and in the other municipalities
comprised in the Province of Cebu, except the Municipalities comprised
in the Fourth Representative District of Cebu, for the purpose of
supplying cold storage therein."
Sec. 5. This Act shall take effect upon its approval. Approved: June 17, 1961 |
