REPUBLIC ACT NO. 9353 September 26, 2006

AN ACT TO INCLUDE CERTAIN PARCEL OF LANDS ACQUIRED BY ACCRETION AS PART OF THE TERRITORIAL JURISDICTION OF THE CITY OF SIPALAY, AMENDING FOR THE PURPOSE SECTION 2 OF REPUBLIC ACT NO. 9027, ENTITLED "AN ACT CONVERTING THE MUNICIPALITY OF SIPALAY, PROVINCE OF NEGROS OCCIDENTAL INTO A COMPONENT CITY TO BE KNOWN AS THE CITY OF SIPALAY"

Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:

Section 1. Section 2 of Republic Act No. 9027 is hereby amended to read as follows:

"SEC. 2. The City of Sipalay. - The Municipality of Sipalay shall be converted into a component city to be known as the City of Sipalay, hereinafter referred to as the City, which shall comprise the present jurisdiction of the Municipality of Sipalay, Negros Occidental Province. The territorial jurisdiction of the City shall be within the present metes and bounds of the Municipality of Sipalay, as follows:

The City of Sipalay is situated in the Province of Negros Occidental, Island of Negros. Bounded on the North by the Municipality of Cauayan along points 1 to 2, on the East by the Municipality of Candoni along points 2 to 3, on the South by the Municipality of Hinoba-an along points 3 to 4, on the West by the Sulu Sea along points 4 to the point of beginning;

Beginning from a point 1 along the shore in the Barrio of Cartegena with latitude 9^o 50'N., longitude 122^o 23'E., running eastward in a straight line direction, until it intersects point 2 with latitude 9^o 50'N., longitude 122^o 35'E.; thence running southward in a straight line direction until it intersects point 3 with latitude 9^o 40'N., longitude 122^o 24'E.: Then following the course of Sulu Sea going up to the point of beginning, containing an area of thirty-seven thousand nine hundred seventy-eight hectares (37,978 has.) more or less.

In addition thereto, the following parcel of lands acquired by reason of accretion shall form part of the territorial jurisdiction of the City:

A parcel of land (Plan of Land MR-06-000002)situated in the Poblacion, City of Sipalay, Province of Negros Occidental, Island of Negros.

Bounded on the SE., along Line 1-2 by Lot 3524, along Line 2-3 by Lot 3525, along Line 3-4 by Lot 3526 cor 4 by Lot 3527 all of Cauayan cadastre, along Lines 4-5-6-7-8 by public land, along Line 8-9 by F-l4-173-D, along Line 9-10 by public land, along Lines 10-11-12-13 by F-14-684-D, Lot 5708, along Line 13-14 by Lot 3592, along Line 14-15 by Lot 3594, Cauayan cad. on the SW., and NW., along Lines 15-16-17-18-19-20-21-22-23-24 by Sulu Sea and on the N., along Line 24-1 by Sipalay River.

Beginning at a point marked "1" on plan being N.18-01 W.756.64 meters from BLLM No. 59, Sipalay cad. thence;

All corners referred to are indicated on plan and are marked on the ground by old points, bearings true surveyed by Engineer Renato C. Cagayanan, surveyed on October 15-16, 1976 and approved on January 24,1978.

Note: Salvage zone of (20.00 m. wide) along Lines 15 to 24 and bank protection of (40.00 m. wide) along Line 24 to 1 is reserved.

A parcel of land (Plan of Land MR-06-000004) situated in the Poblacion, City of Sipalay, Province of Negros Occidental, Island of Negros.

Bounded on the SE., along Lines 1-2-3-4-5 by MR-06-000002 (AMD) Municipal Government of Sipalay, along Lines 5-6-7-8 by proposed DENR-CENRO Sipalay Reservation, along Lines 8-9-10-11-12 by MR-06-000002 (AMD) Municipal Government of Sipalay, on the S., by public land, on the SW., and NW., along Lines 13-14-15-16-17 by Sulu Sea, along Lines 17-18-19-20 by proposed DENR-CENRO Sipalay Reservation, along Lines 20-21-22-23-24-1 by Sulu Sea and on the N., corner 1 by Sipalay River.

Beginning at a point marked "1" on plan being N. 20-49 W. 772.67 meters from BLLM No. 59, Sipalay cad. thence;

Note: Environmental protection of (20.00 m. wide) along Lines 14 to 17 and along Lines 20 to 24-1 is reserved.

A parcel of land (Plan of Land MR-06-000008) situated in the Poblacion, City of Sipalay, Province of Negros Occidental, Island of Negros.

Bounded on the SE., along Lines 1-2-3-4-5-6 by MR-06-000004 Municipal Government of Sipalay, along Line 6-7 by lot proposed DENR-CENRO Sipalay Reservation, along Lines 8-9-10-11-12 by MR-06-000004, Municipal Government of Sipalay, along Lines 12-13-14 MR-06-000002, on the SW., along Lines 14-15-16-17 by Pana-on River, along Lines 17-18-19-20-21-22-23-24-25-26 by Sulu Sea and NW., along Lines 26-1 by Sipalay;

Beginning at a point marked "1" on plan being N. 20-49 W. 772.70 meters from BLLM No. 59, Sipalay cad. thence;

Note: Easement of (20.00 m. wide) along Lines 14 to 26 to 1 is reserved."

The foregoing provision shall be without prejudice to the resolution by the appropriate agency or forum of existing boundary disputes or cases involving questions of territorial jurisdiction between the City of Sipalay and the adjoining local government units.cralawredlawlibrary

Sec. 2. The parcel of lands acquired by reason of accretion as described in the immediately preceding section together with the appurtenances thereto shall belong to the City of Sipalay and thereafter said lands may be sold or leased under such rules and regulations as the city government may promulgate.cralawlibrary

Sec. 3. The Land Registration Authority is hereby mandated to issue separate titles of the above-described parcel of lands within one year from approval of this Act.

Sec. 4. This Act shall take effect upon its approval.

This Act which originated in the House of Representatives was finally passed by the House of Representatives and the Senate on February 21, 2006 and July 25, 2006, respectively.
