REPUBLIC ACT NO. 3612 - AN ACT TO
AMEND REPUBLIC ACT NUMBERED THIRTY-ONE HUNDRED AND TWELVE, ENTITLED "AN
ACT GRANTING THE JAVELOSA BROTHERS COMPANY A FRANCHISE TO CONSTRUCT,
OPERATE AND MAINTAIN AN ICE PLANT IN MANDURIAO, ILOILO CITY, AND TO
SELL ICE IN SAID CITY AND IN HE PROVINCE OF ILOILO" |
Section 1. The second paragraph of Section one of Republic
Act Numbered Thirty-one hundred and twelve is hereby amended to read as
follows: "Said
grantee shall manufacture and supply ice not exceeding thirty
tons daily." Sec. 2. Section three of the same Act is amended to read as follows: "Sec.
3. This franchise is granted subject to the
provisions of the Constitution, and of Commonwealth Act Numbered One
hundred forty-six, as amended, as far as rates are concerned: Provided,
That after the Public Service Commission shall have authorized the
rates that the grantee shall charge, the grantee shall be subject to
inspection and supervision regarding the maintenance and operation of
its plant by the Public Service Commission, which shall from time to
time enforce its rules and regulations." Sec. 3. Section five of the same Act is amended to read as follows: "Sec.
5. The grantee, with the approval of the
Congress of the Philippines first had, may sell, lease, grant, convey,
assign, give in usufruct, or transfer this franchise and all property
and rights acquired thereunder to any qualified individual, association
or corporation competent to operate the business hereby authorized:
Provided, That if Congress is not in session, proper application may
also be made with the Public Service Commission, following the
procedure and forms prescribed by the said Public Service Commission:
Provided, further, That mortgages in favor of any government-owned or
controlled financing institution or corporation may be made by the
grantee without such express approval." Sec. 4. The same Act is further amended by adding a new section thereto which shall read as follows: "Sec.
6-a. The grantee shall, within one hundred
twenty days from the date of approval of this amendatory Act, file with
Congress and the Public Service Commission its written acceptance of
the terms and conditions of this Act." Sec. 5. This Act shall take effect upon its approval. Approved: June 22, 1963. |
