REPUBLIC ACT NO. 5977 - AN
ACT AMENDING REPUBLIC ACT NUMBERED TWENTY-ONE HUNDRED FORTY-ONE,
ENTITLED "AN ACT CREATING THE SUBPROVINCE OF BILIRAN."
Section 1. Section six of Republic Act Numbered Twenty-one
hundred forty-one is amended to read as follows:
"Sec. 6. The governor of the Subprovince of Biliran
shall exercise therein all the executive powers of a provincial
governor. He shall not be a member of the Provincial Board of Leyte."
Sec. 2. The same Act is amended by inserting
between Section s seven and eight thereof the following sections:
"Sec. 7-A. The Office of the Deputy Provincial
Treasurer, including its personnel, of the Province of Leyte, is hereby
transferred to the Subprovince of Biliran, and the physical transfer of
the said office to the capital of the said subprovince shall be
effected within thirty days from the date of the approval of this
Act.
"Sec. 7-B. There shall be an auditor for the
Subprovince of Biliran with permanent station at its capital. He shall
exercise the functions of a provincial auditor in the said subprovince.
He shall be assisted by such personnel as may be determined by the
Provincial Board of Leyte. The operating expenses of the Office of the
Auditor of the said subprovince shall be paid by it. The salaries of
all the personnel in the said office shall be fixed by the governor.
"Sec. 7-C. One hundred per centum of all provincial
taxes, fines, or other revenue collected in the Subprovince of Biliran
or by reason of any right originating therein shall accrue to the
treasury of the said subprovince for the sole use and benefit thereof.
All the proceeds of the road tax of the subprovince shall also accrue
in their entirety to its treasury. There shall accrue to the treasury
of the said subprovince, for the sole use and benefit thereof, one
hundred per centum of the internal revenue and special allotments
apportioned to the Province of Leyte in respect to the number of
inhabitants in the said subprovince.
"Sec. 7-D. All funds accruing to the Subprovince of
Biliran shall be expended for its exclusive benefit."
Sec. 3. Whenever the phrase "lieutenant-governor"
appears in the Republic Act Numbered twenty-one hundred forty-one, it
shall read "Governor."
Sec. 4. This Act shall take effect upon its
approval.
