PEOPLE OF THE PHILIPPINES V. CRISCENCIO CARILO Y GODO

Quoted hereunder; for your information, is a resolution of the Court En Banc dated November 20, 2007
G.R. No. 170838: People of the Philippines v. Criscencio Carilo y Godo
After a careful review of the records of the case, the Court finds no reversible error in the assailed decision. However, in view of the effectivity of Republic Act No. 9346 (An Act Prohibiting the Imposition of Death Penalty in the Philippines), the imposition of death has been prohibited and in lieu thereof, the penalty of reclusion perpetua should be imposed, without eligibility for parole.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the Decision dated 22 September 2005 of the Court of Appeals in CA-G.R. CR HC No. 01280, finding appellant Criscencio Carilo y Godo guilty beyond reasonable doubt of the crime of Qualified Rape, and AFFIRMS said Decision with the MODIFICATION that the penalty of death imposed is reduced to reclusion perpetua without eligibility for parole, pursuant to Republic Act No. 9346.
