"A. M. No. 04-11-319-MTC.- Re: Designation of Assisting Judge in the MTCC of Lapu-Lapu City.- The Court Resolved, upon the recommendation of the Office of the Court Administrator, to

(b) For the thirty-one (31) cases with complete transcript of stenographic notes (TSNs) and /or ready for decision -

(b-1)  DIRECT the Clerk of Court of MTCC, Lapu-Lapu City to TRANSMIT to MTCC, City of Naga, Cebu, within five (5) days from notice hereof, the entire records of the following thirty-one (31) case, to wit: Criminal Case Nos. (c.2) ORDER the Clerk of Court, MTCC, Lapu-Lapu City, to (i) MONITOR the submission of the TSNs; (ii) immediately TRANSMIT the records of the case to MTCC, City of Naga, Cebu, as soon as all the TSNs of a case shall have been completed; and (iii) APPRISE Judge Gestopa of the cases with incomplete TSNs at the end of the period given to stenographers to complete the same; and

(c.3) DIRECT Judge Gestopa to DECIDE the referred cases with completed TSNs within ninety (90) days from receipt of the records thereof following the same procedure in b.2 above for the filing and promulgation of decision and submission of copies of decision to this Court as proof of compliance;

(d) For the forty (40) cases wit missionf records and the remaining cases with incomplete TSNs at the end of the grace period given to stenographes to complete the same -

(d.1) DIRECT Judge Gestopa to TAKE APPROPRIATE ACTION on the subject inherited cases such as but not limited to the conduct of hearings at the MTCC, Lapu-Lapu City, for tje reconstitution of the testimonies of witnesses utilizing for the purpose the court personnel thereat;

(d.2) AUTHORIZE Judge Gestopa to receive per diems and reimbursement of traveling expenses whenever he goes to MTCC, Lapu-Lapu City, to conduct hearings; and

(d.3) DIRECT Judge Gestopa to DECIDE the said cases within ninety (90) days from the time they become ready for decision-making, meaning with complete TSNs and/or reconstituted records, following the same procedure in b.2 above for the filing anf promulgation of decision and submission of copies of decision of this Court as proof of compliance;

(e) GRANT Jugde Judge Getopa a judicial incentive allowance of Five Hundred Pesos (P500.00) for every case decided, provided, however, that consolidated cases shall be considered as one (1) case only for purposes of the grant of said allowance;

(e) REQUIRE Hon. Ester M. Veloso, Presiding Judge, Regional Trial Court, Branch 6, Cebu City, to SUBMIT a written explanation within ten (10) days from notice hereof why she failed to comply with the Resolution of December 6, 2005, directing her, among others, to investigate and determine the cause/s of the loss of the loss of the case records of inherited cases in MTCC, Lapu-Lapu City; and

(f) RELIEVE Judge Veloso of the duty to investigate and act on said cases in view of her appointment to the second level court."
