PEOPLE OF THE PHILIPPINES VS. ROMEO BORENAGA

Quoted hereunder, for your information, is a resolution of the First Division of this Court dated 16 March 2009
G.R. No. 185713: PEOPLE OF THE PHILIPPINES vs. ROMEO BORENAGA
After a careful review of the records of the case, the Court finds no reversible error in the assailed Decision. However, the Court increases the award of civil indemnity to P75,000 from P50,000, the award of moral damages to P75,000 from P50,000, and the award of exemplary damages to P30,000 from P25.000, pursuant to prevailing jurisprudence.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the 12 September 2008 Decision of the Court of Appeals in CA-G.R. CR-HC No. 00275-MIN finding appellant Romeo Borenaga guilty beyond reasonable doubt of the crime of qualified rape and AFFIRMS said Decision with the MODIFICATION that the award of civil indemnity be increased to P75,000 from P50,000, the award of moral damages be increased to P75,000 from P50,000, and the award of exemplary damages be increased to P30,000 from P25,000; pursuant to prevailing jurisprudence.
