THE PEOPLE OF THE PHILIPPINES VS. ROGELIO CELIS (AT LARGE) AND ROBERTO CELIS

Quoted hereunder, for your information, is a resolution of the First Division of this Court dated 16 March 2009
G.R. No. 186034: THE PEOPLE OF THE PHILIPPINES vs. ROGELIO CELIS (At Large) and ROBERTO CELIS
After a careful review of the records of the case, the Court finds no reversible error in the assailed Decision. However, the Court increases the award of temperate damages to P30,000 each from P253000 each, or a total of P90,000 for all three counts; and the award of exemplary damages to P30,000 each from P25,000 each, or a total of P90;000 for all three counts, pursuant to prevailing jurisprudence.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the 22 July 2008 Decision of the Court of Appeals in CA-G.R. CR-HC No. 00210-MIN finding appellant Roberto Celis guilty beyond reasonable doubt as principal in three (3) counts of murder, and AFFIRMS said Decision with the MODIFICATION that the award of temperate damages be increased to P30,000 each from P25,000 each, or a total of P90,000 for all three counts, and the award of exemplary damages to P30;000 from P25,000 each, or a total of P90,000 for all three counts, pursuant to prevailing jurisprudence.
