RE: RECOMMENDATION OF ASSISTANT SOLICITOR GENERAL KARL B. MIRANDA, OFFICE OF THE SOLICITOR GENERAL [OSG], RELATIVE TO THE EFFORTS OF THE SUPREME COURT TO EXPEDITE THE HEARINGS OF CASES INVOLVING JAIL INMATES AND PRISONERS

Quoted hereunder, for your information, is a resolution of the Court En Bane dated February 16, 2010
"A.M. No. 10-1-01-O (Re: Recommendation of Assistant Solicitor General Karl B. Miranda, Office of the Solicitor General [OSG], Relative to the Efforts of the Supreme Court to Expedite the Hearings of Cases Involving Jail Inmates and Prisoners). - The Court Resolved to

"A.M. No. 10-1-01-O (Re: Recommendation of Assistant Solicitor General Karl B. Miranda, Office of the Solicitor General [OSG], Relative to the Efforts of the Supreme Court to Expedite the Hearings of Cases Involving Jail Inmates and Prisoners). - The Court Resolved to
(a) NOTE the Memorandum dated January 22, 2010 of Deputy Court Administrator Nimfa Cuesta-Vilches relative to the letter dated September 18, 2009 of Assistant Solicitor General Karl B. Miranda;
(b) NOTE the aforesaid Letter of ASG Miranda, submitting recommendations relative to the efforts of the Supreme Court to expedite the hearings of cases involving jail inmates and prisoners;
(c) DIRECT the Office of the Court Administrator to IMPLEMENT the following recommendations of the OSG through a circular for all the lower courts, to quote:"1. Jail inmates and prisoners be given access to crucial information on their cases. This can be done by requiring copies of pleadings, motions, orders, resolutions and decisions thereon, to be served upon them, and not only upon their legal counsels. Service to legal counsel of said pleadings, motions orders, resolutions and decisions, however, remains to be the reckoning period for filing motions for reconsideration, new trial, appeal or petitions for review,(d) REFER the following recommendation of the OSG to the MANAGEMENT INFORMATION SYSTEMS OFFICE for report and recommendation thereon within sixty (60) days from notice hereof, to quote:
2. Copies of the abovementioned pleadings be given to the Bureau of Corrections and the Bureau of Jail Management and Penology, as the case may be"
4. An appropriate information sharing system between the pillars of justice be adopted to prevent situations, where courts issue warrants for the arrest of an accused or archive a case because they were not properly informed that the accused is already in jail or prison, if possible, a national court case database should likewise be adopted."
