G.R. No. 197854 - JOSE MIGUEL T. ARROYO, petitioner, v. SEC. LEILA M. DE LIMA, in her capacity as SECRETARY OF JUSTICE and RICARDO A. DAVID, JR., in his capacity as COMMISSIONER, BUREAU OF IMMIGRATION, respondents.
Petitioner Jose Miguel T. Arroyo, in his Petition for Certiorari and Prohibition (with prayer for the issuance of a temporary restraining order and/or writ of preliminary injunction) dated August 12, 2011, seeks to nullify and set aside Watchlist Order No. 2011-410 (dated August 4, 2011 issued by Secretary Leila de Lima of the Department of Justice) and Department of Justice Circular No. 41 pursuant to which Watchlist Order No. 2011-410 was issued.
After deliberating on the petition and after considering that the petitioner is not an accused in a criminal case, nor is a respondent in any preliminary investigation, and is not the subject of any warrant of arrest in the on-going Senate investigation on the purchase by the Philippine National Police of helicopters, and without necessarily giving due course to the petition, the Court resolves: (1) to require the respondents to COMMENT on the petition within ten (10) days from receipt of this Resolution; (2) to require the petitioner to INDICATE the date of his receipt of the Watchlist Order of August 4, 2011; and (3) to ISSUE the TEMPORARY RESTRAINING ORDER prayed for. This temporary restraining order enjoins the respondents from further implementing the assailed Watchlist Order and Circular against petitioner Jose Miguel T. Arroyo, effective immediately until further orders from this Court."
