PEOPLE OF THE PHILIPPINES V. ROMEO ALAQUIN Y DOE
G.R. No. 194290 (People of the Philippines v. Romeo Alaquin y Doe) - Considering the allegations, issues and arguments presented in the appeal, the Court resolves to DISMISS the appeal for failure to sufficiently show that the Court of Appeals committed any reversible error in its assailed Decision dated May 19, 2010, as to warrant the exercise of the Court's appellate jurisdiction.
IN VIEW OF THE FOREGOING, the Court ADOPTS the findings and conclusions of law in the Decision dated May 19, 2010 of the Court of Appeals in CA-G.R. CR-H.C. No. 02974 and AFFIRMS said Decision finding appellant Romeo Alaquin y Doe guilty beyond reasonable doubt of the crime of murder and sentencing him to suffer the penalty of reclusion perpetua and indemnify the heirs of the victim in the amount of P9,000.00 as actual damages and P23,999.99 as loss of earning capacity and to pay the costs of the suit with MODIFICATION that he will not be eligible for parole and to pay the increased amount of the following damages to the heirs of the victim: civil indemnity of Seventy-Five Thousand Pesos (P75,000.00) and moral damages amounting to Seventy-Five Thousand Pesos (P75,000.00), and an additional award of exemplary damages of Thirty Thousand (P30,000.00) in view of recent jurisprudence.
