REYNALDO DIVINO Y GUINOCAN V. PEOPLE OF THE PHILIPPINES
G.R. No. 196663 (REYNALDO DIVINO y GUINOCAN v. PEOPLE OF THE PHILIPPINES). - Considering the allegations, issues and arguments adduced in the petition for review on certiorari assailing the Decision dated October 5, 2010 and Resolution dated March 18, 2011 of the Court of Appeals, in CA-G.R. CR-HC No. 00727 MIN, the Court resolves to DENY the petition for failure to sufficiently show any reversible error in the assailed judgment and AFFIRMS said Decision and Resolution finding petitioner Reynaldo Divino y Guinocan guilty beyond reasonable doubt of the crime of Murder under Article 248 of the Revised Penal Code, as amended by Republic Act No. 7659, sentencing him to suffer the penalty of imprisonment of reclusion perpetua and to pay the heirs of the deceased victim the amounts of P50,000.00 as moral damages, P50,000.00 as actual damages, with MODIFICATION that the award of civil indemnity for the victim's death be decreased to P50,000.00, and the award of exemplary damages be increased to P30,000.00 in view of prevailing jurisprudence.
