IN THE MATTER OF THE PETITION FOR THE WRIT OF AMPARO OF ENGINEER MORCED N. TAGITIS; AND MARY JEAN B. TAGITIS, HEREIN REPRESENTED BY ATTY. FELIPE P. ARCILLA, JR., ATTORNEY-IN-FACT V. GENERAL EDGARDO M. DOROMAL, CHIEF, CRIMINAL INVESTIGATION AND DETECTION GROUP, ET AL.
G.R. No. 182498 (In the Matter of the Petition for the Writ of Amparo of Engineer Morced N. Tagitis; and Mary Jean B. Tagitis, herein represented by Atty. Felipe P. Arcilla, Jr., Attorney-in-Fact v. General Edgardo M. Doromal, Chief, Criminal Investigation and Detection Group, et al.).- In compliance with the Court's directive in its Decision dated December 3, 2009, the Court of Appeals (CA) submitted the Fourth Quarterly Monitoring Report on the Investigations of the Philippine National Police (PNP) and the PNP-Criminal Investigation and Detection Group (C1DG) on the Enforced Disappearance of Engr. Morced N. Tagitis on June 15, 2011.
The Report duly noted the investigation undertaken and the results achieved in the Compliance submitted by the PNP Chief and the CIDG Director, and recommended that the case be temporarily archived and treated as a cold case, following the recommendation made by Police Director General Raul M Bacalazo. At the same time, the Report also noted that the Compliance �does not mention anything about the following matters which [the Court of Appeals] recommended to be included[, specifically;] (1) the reported sightings of [Engr.] Tagitis with terrorists and his alleged custody in Talipapao, Sulu; (2) [whether Engr.] Tagitis [is] a liaison for the Je'maah Islamiah who had been under surveillance since 2007; and (3) [whether Engr.] Tagitis was under custodial investigation by government operatives for complicity with the Je'maah Islamiah after he was seen talking with Omar Patik and a certain Santos of Bulacan, a 'Balik Islam' charged with terrorism.�[1]
Considering that these omissions involve considerations that may be material in guiding this Court in formulating remedial measures to locate Engr. Morced N. Tagitis and in deciding the outcome of this Amparo petition, we hold in abeyance our action on the recommendation to temporarily archive the case, and direct the PNP Chief and the CIDG Director to further investigate and report to this Court the matters noted by the Court of Appeals, within 90 days from receipt of this Resolution."
