PEOPLE OF THE PHILIPPINES V. RONALD D. CATUIZA
G.R. No. 186133 (PEOPLE OF THE PHILIPPINES v. RONALD D. CATUIZA). - Considering the allegations, issues and arguments presented in the appeal, the Court resolves to DISMISS the appeal for failure to sufficiently show that the Court of Appeals committed any reversible error in its assailed Decision dated June 20, 2008 as to warrant the exercise of the Court's appellate jurisdiction.
IN VIEW OF THE FOREGOING, the Court ADOPTS the findings and conclusions of law in the Decision dated June 20, 2008 of the Court of Appeals in CA-G.R. CR-HC No. 02356 and AFFIRMS said Decision finding appellant Ronald D. Catuiza guilty beyond reasonable doubt of the following crimes; (1) Acts of Lasciviousness, in relation to RA No. 7610 sentencing him to suffer the indeterminate penalty of 12 years and 1 day of reclusion temporal minimum, as minimum, to 17 years and 4 months of reclusion temporal medium, as maximum, and to pay the victim the amounts of P30,000.00 as civil indemnity, P30,000.00 as moral damages, and P10,000.00 as exemplary damages; and (2) Two (2) counts of Qualified Rape, in relation to RA No. 7610 sentencing him to suffer the penalty of reclusion perpetua in each count of rape without eligibility of parole in accordance with Section 2 of RA No. 9346, and to pay the private complainant, in each count of rape, the amounts of P75,000.00 as civil indemnity and P75,000.00 as moral damages, with MODIFICATION that the award of exemplary damages be increased from P20,000.00 to P30,000.00 in each count of rape, in view of prevailing jurisprudence.
