PEOPLE OF THE PHILIPPINES V. JUNELAN DELOS SANTOS Y MADILINE @ BOYET
G.R. No. 194237 (People of the Philippines v. Junelan delos Santos y Madiline @ Boyet) - Considering the allegations, issues and arguments presented in the appeal, the Court resolves to DISMISS the appeal for failure to sufficiently show that the Court of Appeals committed any reversible error in its assailed Decision dated July 22, 2010, as to warrant the exercise of the Court's appellate jurisdiction.
IN VIEW OF THE FOREGOING, the Court ADOPTS the findings and conclusions of law in the Decision dated July 22, 2010 of the Court of Appeals in CA-G.R. CR-H.C. No. 00605-MIN and AFFIRMS said Decision finding appellant Junelan delos Santos y Madiline @ Boyet guilty beyond reasonable doubt for violations of Section 5, Article II of Republic Act 9165, otherwise known as the Comprehensive Dangerous Drugs Act of 2002, sentencing him to suffer the penalty of life imprisonment, with MODIFICATION that appellant is ordered to pay a fine of Five Hundred Thousand Pesos (P500,000.00), and also of Section 11, Article II of the same law, sentencing him to suffer the penalty of imprisonment of twelve (12) years and one (1) day to twenty (20) years and to pay a fine of Three Hundred Thousand Pesos (P300,000.00)
