G.R. No. 194257: PEOPLE OF THE PHILIPPINES v. MARIO SABATE, JR. y LABANON
After a careful review of the records of the case, the Court finds no reversible error in the assailed Decision. However, the Court increases the award of exemplary damages from P25,000.00 to P30,000.00 and the award of temperate damages from P25,000.00 to P30,000.00, pursuant to prevailing jurisprudence.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the 30 July 2010 Decision of the Court of Appeals in CA-G.R. CR-HC No. 00502-MIN finding appellant Mario Sabate, Jr. y Labanon guilty beyond reasonable doubt of the crime of murder and AFFIRMS said Decision with the following MODIFICATIONS: (1) the award of exemplary damages is increased from P25,000.00 to P30,000.00, and (2) the award of temperate damages is increased from P25,000.00 to P30,000.00, pursuant to prevailing jurisprudence. Sereno, J., on leave; Peralta, J., designated additional member per S.O. No. 1067.
