PEOPLE OF THE PHILIPPINES V. ERLINDO CONTRILLON Y VILAN
G.R. No. 181824 (People of the Philippines v. Erlindo Contrillon y Vilan). - Considering the allegations, issues and arguments presented in the appeal, the Court resolves to DISMISS the appeal for failure to sufficiently show that the Court of Appeals committed any reversible error in its assailed Decision dated August 24, 2007 as to warrant the exercise of the Court's appellate jurisdiction.
IN VIEW OF THE FOREGOING, the Court ADOPTS the findings and conclusions of law in the Decision dated August 24, 2007 of the Court of Appeals in CA-G.R. CR-HC No. 02260 and AFFIRMS said Decision finding appellant Erlindo Contrillon y Vilan guilty beyond reasonable doubt of the crime of Murder penalized under the Revised Penal Code sentencing him to suffer the penalty of reclusion perpetua and to pay the heirs of the victim civil indemnity of Fifty Thousand Pesos (P50,000.00) and moral damages amounting to Fifty Thousand Pesos (P50,000.00), but with MODIFICATION imposing the additional amount of P30,000.00 as exemplary damages in view of recent jurisprudence.
