PEOPLE OF THE PHILIPPINES VS. NANET ARAZA AND GLORIA ARANETA
Sirs/Mesdames:
Please take notice that the Court, Second Division, issued a Resolution dated 10 January 2011 which reads as follows:
G.R. No. 188703 (People of the Philippines v. Nanet Araza and Gloria Araneta). - The records of this case were elevated to this Court on July 29, 2009, pursuant to the Court of Appeals Resolution dated June 2, 2009 which gave due course to the notice of appeal filed by accused-appellants Nanet Araza and Gloria Araneta.
In compliance with the Court's Resolution dated August 19, 2009, both parties filed their respective Manifestations in lieu of Supplemental Brief. The Office of the Solicitor General stated that it is not filing a supplemental brief with this Court considering that all errors assigned in the accused-appellants' brief have already been thoroughly refuted and discussed in its appellee's brief. On the other hand, the accused-appellants manifested that they are adopting their appellants' brief as their supplemental brief, the same having adequately discussed all the matters pertinent to their defense.
After a perusal of the records of the case, the Court resolves to DISMISS the appeal for failure of the appellants to sufficiently show reversible error in the challenged decision to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the Court ADOPTS the findings of fact and conclusion of law in the Decision dated April 30, 2009 of the Court of Appeals in CA-G.R. CR-H.C. No. 01875, finding accused-appellants Nanet Araza and Gloria Araneta guilty beyond reasonable doubt of violation of Section 5, Article II, Republic Act No. 9165 (Comprehensive Dangerous Drugs Act of 2002), and AFFIRMS said decision in toto.
SO ORDERED.
