ELY FEGALAN V. PEOPLE OF THE PHILIPPINES
G.R. No. 146210 (Ely Fegalan v. People of the Philippines). - Considering the allegations, issues and arguments presented in the petition, the Court resolves to DENY the petition for failure to sufficiently show that the Court of Appeals committed any reversible error in its assailed Decision dated February 7, 2000 as to warrant the exercise of the Court's appellate jurisdiction.
IN VIEW OF THE FOREGOING, the Court ADOPTS and AFFIRMS the findings and conclusions of law in the Decision dated February 7, 2000 of the Court of Appeals in CA-G.R. CR-H.C. No. 19731, finding petitioner Ely Fegalan guilty beyond reasonable doubt of the crime of homicide and sentencing him to suffer the penalty of ten (10) years and one (1) day of prision mayor, as minimum, to seventeen (17) years, four (4) months and one (1) day of reclusion temporal, as maximum, and to indemnify the heirs of the victim Oscar Fedilino in the amount P50,000.00. Petitioner shall be credited with time served under detention.
