HENRY GUEVARRA Y VIZCARRA AND DEMETRIO BAUTISTA III V. PEOPLE OF THE PHILIPPINES
G.R. No. 184234 (HENRY GUEVARRA y VIZCARRA and DEMETRIO BAUTISTA III v. PEOPLE OF THE PHILIPPINES) - Considering the allegations, issues and arguments presented in the Petition for Review, together with the Comment and the Manifestation in lieu of Reply, the Court resolves to DENY the petition for failure to sufficiently show that the Court of Appeals committed any reversible error in its assailed Decision dated June 18, 2008 and Resolution dated August 14, 2008 as to warrant the exercise of the Court's appellate jurisdiction.
IN VIEW OF THE FOREGOING, the Court ADOPTS the findings and conclusions of law in the Decision dated June 18, 2008 and Resolution dated August 14, 2008 of the Court of Appeals in CA-G.R. CR No. 30516 and AFFIRMS said Decision (a) finding petitioners Henry Guevarra y Vizcarra and Demetrio Bautista III guilty beyond reasonable doubt of violation of Section 15, Article III of R.A. No. 6425, as amended, with MODIFICATION that both petitioners are hereby sentenced to suffer the indeterminate penalty of imprisonment of six (6) months of arresto mayor maximum, as minimum, to four (4) years and eight (8) months of prision correccional medium, as maximum, and to suffer the accessory penalties provided for by law; and (b) finding petitioner Henry Guevarra y Vizcarra guilty beyond reasonable doubt of violation of Section 16, Article III of R.A. No. 6425, as amended, with MODIFICATION that petitioner Guevarra is hereby sentenced to suffer the indeterminate penalty of imprisonment of six (6) months of arresto mayor maximum, as minimum, to four (4) years and eight (8) months of prision correccional medium, as maximum, and to suffer the accessory penalties provided for by law.
