EDMUNDO C. ABEL AND REYNALDO C. ABEL V. PEOPLE OF THE PHILIPPINES
G.R. No. 183748 (EDMUNDO C. ABEL and REYNALDO C. ABEL v. PEOPLE OF THE PHILIPPINES). - Considering the allegations, issues and arguments presented in the Petition for Review, together with the Comment and the Reply, the Court resolves to DENY the petition for failure to sufficiently show that the Court of Appeals committed any reversible error in its assailed Decision dated July 2, 2008, as to warrant the exercise of the Court's appellate jurisdiction.
IN VIEW OF THE FOREGOING, the Court ADOPTS the findings and conclusions of law in the Decision dated July 2, 2008 of the Court of Appeals in CA-G.R. CR No. 30370 and AFFIRMS said Decision finding petitioners Edmundo C. Abel and Reynaldo C. Abel guilty beyond reasonable doubt of the crime of Homicide as defined and penalized under Article 249 of the Revised Penal Code, sentencing each of them to suffer the indeterminate prison term of eight (8) years and one (1) day of prision mayor, as minimum, to fourteen (14) years, eight (8) months and one (1) day of reclusion temporal, as maximum, and to pay solidarity the heirs of the victim the amount of P50,000.00 as civil indemnity, with MODIFICATION that the petitioners are ordered to solidarily pay the heirs of the victim the additional amount of P50,000.00 as moral damages.
