ROMEO RIVERA V. PEOPLE OF THE PHILIPPINES
G.R. No. 180746 (ROMEO RIVERA v. PEOPLE OF THE PHILIPPINES). - Considering the allegations, issues and arguments presented in the Petition for Review, together with the Comment and the Reply, the Court resolves to DENY the petition for failure to sufficiently show that the Court of Appeals committed any reversible error in its assailed Decision dated July 27, 2007 and its assailed Resolution dated November 26, 2007 as to warrant the exercise of the Court's appellate jurisdiction.
IN VIEW OF THE FOREGOING, the Court ADOPTS the findings and conclusions of law in the Decision dated July 27, 2007 and Resolution dated November 26, 2007 of the Court of Appeals in CA-G.R. CR No. 29991 and AFFIRMS said Decision and Resolution finding petitioner Romeo Rivera guilty beyond reasonable doubt of six (6) counts of violation of Batas Pambansa Blg. 22 imposing upon him the penalty of fine in each count with subsidiary imprisonment in case of insolvency with MODIFICATION that the amount of fine imposed in each count is decreased from Pl,000,000.00 to P200,000.00, pursuant to the provision of BP Blg. 22. The order upon petitioner to pay the value of the checks with interest at 12% per annum from August 29, 1990 until the whole amount is paid is, likewise, sustained.
