MARIO B. TANPINCO V. JUDGE MANUEL Q. LIMSIACO, JR.
A.M. No. MTJ-10-1757 (Mario B. Tanpinco v. Judge Manuel Q. Limsiaco, Jr.). � Under consideration is another case filed against. Judge Manuel Q. Limsiaco, Jr., charging him of grave misconduct, obstruction of justice, and abuse of authority in connection with the invalid issuance of an order of provision release of an accused.
Pending the resolution of this case, supervening events occurred that rendered the petition moot and academic. First, Judge Limsiaco retired from the service. Second, in the case of Judge Napoleon E. Inoturan v. Judge Manuel Q. Limsiaco, Jr., etc. and Sancho E. Guinanao v. Judge Manuel Q. Limsiaco, Jr., etc.[1] we declared Judge Limsiaco�s retirement benefits forfeited, except for his accrued leave credits; we also declared him disqualified from re-employment in any branch or service of the government, including government-owned and controlled corporations. Thus, as we can no longer impose any administrative penalty on Judge Limsiaco, we now have no choice but to dismiss the present case for being moot and academic.[2]
ACCORDINGLY, premises considered, we DISMISS the administrative case against retired Judge Manuel Q. Limsiaco, Jr., for being moot and academic. Sereno, J., on official leave; Peralta, J., designated additional member per S.O. No. 1040.
