SERGIO MALIT AND RENATO ASUNCION V. PEOPLE OF THE PHILIPPINES
G.R. No. 183585 (SERGIO MALIT and RENATO ASUNCION v. PEOPLE OF THE PHILIPPINES). - Considering the allegations, issues and arguments presented in the Petition for Review, together with the Comment and the Reply, the Court resolves to DENY the petition for failure to sufficiently show that the Court of Appeals committed any reversible error in its assailed Decision dated March 22, 2006 and Resolution dated August 7, 2006, as to warrant the exercise of the Court's appellate jurisdiction.
IN VIEW OF THE FOREGOING, the Court ADOPTS the findings and conclusions of law in the Decision dated March 22, 2006 of the Court of Appeals in CA-G.R. CR No. 28040 and AFFIRMS said Decision finding petitioners Sergio Malit and Renato Asuncion guilty beyond reasonable doubt of the crime of Qualified Theft as defined and penalized under Article 310 of the Revised Penal Code, sentencing them to each suffer the indeterminate penalty of four (4) years, two (2) months and one (1) day of prision correccional maximum to eight (8) years and one (1) day of prision mayor medium.
