NORBERTO C. VALERA V. PEOPLE OF THE PHILIPPINES
G.R. No. 183343 (NORBERTO C. VALERA v. PEOPLE OF THE PHILIPPINES). - Considering the allegations, issues and arguments presented in the Petition for Review, together with the Comment and Manifestation in lieu of Reply, the Court resolves to DENY the petition for failure to sufficiently show that the Court of Appeals committed any reversible error in its assailed Decision dated February 28, 2008 and Resolution dated June 12, 2008 as to warrant the exercise of the Court's appellate jurisdiction.
IN VIEW OF THE FOREGOING, the Court ADOPTS the findings and conclusions of law in the Decision dated February 28, 2008 of the Court of Appeals in CA-G.R. CR No. 30109 and AFFIRMS said Decision finding petitioner Norberto C. Valera guilty beyond reasonable doubt of illegal possession of dangerous drugs in violation of Section 11, Article II of Republic Act No. 9165, otherwise known as the Comprehensive Dangerous Drugs Act of 2002, sentencing him to suffer the indeterminate penalty of 12 years and 1 day, as minimum, to 17 years and 4 months, as maximum; to pay a fine of P300,000.00 without subsidiary imprisonment in case of insolvency; and to pay the costs.
