PEOPLE OF THE PHILIPPINES VS. AMALIA REGATSUELO
G.R. No. 195237 (People of the Philippines vs. Amalia Regatsuelo). - The records of this case were elevated to this Court on February 10, 2011, pursuant to the Court of Appeals Resolution dated August 24, 2010 which gave due course to the notice of appeal filed by accused-appellant Amalia Regatsuelo.
In compliance with the Court's Resolution dated February 28, 2011, the Office of the Solicitor General filed its manifestation stating that it was no longer filing a Supplemental Brief with this Court; and that it was adopting all the allegations, issues and arguments adduced in its Appellee's brief filed before the Court of Appeals (CA). The accused-appellant, on the other hand, filed her Supplemental Brief on April 29, 2011.
After a perusal of the records of the case, the Court resolves to DISMISS the appeal for failure of the appellant to sufficiently show reversible error in the challenged decision warranting the exercise of the Court's appellate jurisdiction.
WHEREFORE, the Court ADOPTS the findings of fact and conclusion of law in the Decision dated July 29, 2010 of the Court of Appeals in CA-G.R. CR-HC No. 03842, finding accused-appellant Amalia Regatsuelo a.k.a. "Amy," in Criminal Case No. 14101-D, guilty beyond reasonable doubt of Violation of Section 5, Article II of RA No. 9165 and to suffer the penalty of life imprisonment and a fine of Five Hundred Thousand Pesos (P500,000.00) with the accessory penalties provided under Section 35 of the RA No. 9165 and, in Criminal Case No. 14102-D, guilty beyond reasonable of Violation of Section 11, Article II of RA No. 9165 and to suffer the penalty of imprisonment of Twelve (12) Years and One (1) day, as minimum, to Sixteen (16) Years, as maximum, and a fine of Three Hundred Thousand Pesos (P300,000.00) with accessory penalties provided under Section 35 of the RA No. 9165.
