PEOPLE OF THE PHILIPPINES V. NYMPHA HUELAR Y FRINCELLO AND SONNY SANTILLAN Y DE ASIS
G.R. No. 194609 (People of the Philippines v. Nympha Huelar y Frincello and Sonny Santillan y de Asis). - The records of this case were elevated to this Court on December 15, 2010, pursuant to the Court of Appeals Resolution dated May 25, 2010 which gave due course to the notice of appeal filed by appellants Nympha Huelar y Frincello and Sonny Santillan y de Asis.
In compliance with the Court's Resolution dated January 19, 2011, the Office of the Solicitor General and the Public Attorney's Office filed their respective Manifestations stating that they are no longer filing a Supplemental Brief with this Court and that they are adopting all the allegations, issues and arguments adduced in their Briefs filed before the Court of Appeals.
After a perusal of the records of the case, the Court resolves to DISMISS the appeal for failure of appellants to sufficiently show reversible error in the challenged decision to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the Decision dated April 15, 2010 of the Court of Appeals in CA-G.R. CR.-H.C. No. 03516, finding appellants Nympha Huelar y Frincello and Sonny Santillan y de Asis guilty beyond reasonable doubt for violation of Section 5, Article II of R.A. No. 9165, and AFFIRMS said Decision.
