PEOPLE OF THE PHILIPPINES V. LUISITO MASCARIÑA Y LEAL
G.R. No. 184052 (PEOPLE OF THE PHILIPPINES v. LUISITO MASCARI�A y LEAL). - Considering the allegations, issues and arguments presented in the appeal, the Court resolves to DISMISS the appeal for failure to sufficiently show that the Court of Appeals committed any reversible error in its assailed Decision dated January 25, 2008 as to warrant the exercise of the Court's appellate jurisdiction.
IN VIEW OF THE FOREGOING, the Court ADOPTS the findings and conclusions of law in the Decision dated January 25, 2008 of the Court of Appeals in CA-G.R. CR-HC No. 01346 and AFFIRMS said Decision finding appellant Luisito Mascari�a y Leal guilty beyond reasonable doubt of sixteen (16) counts of Qualified Rape as defined and penalized under Articles 266-A and 266-B, paragraph (1) of Republic Act No. 8353, sentencing him to suffer the penalty of reclusion perpetua in each count of rape and to pay the private complainant, in each count of rape, the amounts of P75,000.00 as civil indemnity, P75,000.00 as moral damages, and to support his child with private complainant with MODIFICATION that the award of exemplary damages be increased from P25,000.00 to P30,000.00 in each count of rape in view of prevailing jurisprudence.
