G.R. No. 198427 (Lee Michael Leonidas Quizon v. Ferrotech Steel Corporation and Benito T. Keh).
RESOLUTION
The Court, after a review of the records, resolves to DENY the petition for failure to show that the Court of Appeals (CA) committed reversible error when it ruled that it is the regional trial courts, and not the Labor Arbiter, that have jurisdiction over the case. When petitioner Lee Michael Leonidas Quizon submitted his explanation to respondent Benito T. Keh, he claimed that Keh had no right to take any action against him without prior board approval since he was an elected officer of the board of directors. He also admitted in his pleadings that he was both a stockholder and a corporate officer of respondent Ferrotech Steel Corporation. As the CA aptly noted, since the dismissal involved a corporate officer, an intra- corporate controversy arose which falls under the jurisdiction of the regional trial courts.cralaw
