EDWIN FARIÑAS V. PEOPLE OF THE PHILIPPINES
G.R. No. 180468 (EDWIN FARIŅAS v. PEOPLE OF THE PHILIPPINES); G.R. No. 181748 (PEOPLE OF THE PHILIPPINES v. EDWIN FARIŅAS). - Considering the allegations, issues and arguments presented in the petition for review in G.R. No. 180468 and in the automatic review in G.R. No. 181748, which assail the same Decision of the Court of Appeals dated July 31, 2007 in CA-G.R. CR-HC No. 01607, the Court resolves to DENY the petition for review in G.R. No. 180468 and to DISMISS the appeal in G.R. No. 181748 for failure to sufficiently show that the Court of Appeals committed any reversible error in its assailed Decision as to warrant the exercise of the Court's appellate jurisdiction.
IN VIEW OF THE FOREGOING, the Court ADOPTS the findings and conclusions of law in the Decision dated July 31, 2007 of the Court of Appeals in CA-G.R. CR-HC No. 01607 and AFFIRMS said Decision finding petitioner-appellant Edwin Fariņas guilty beyond reasonable doubt of the crime of Rape, as defined and penalized under Article 335 of the Revised Penal Code, sentencing him to suffer the penalty of reclusion perpetua, together with the accessory penalties provided for by law, and to pay the private complainant the amounts of P50,000.00 as civil indemnity, P50,000.00 as moral damages, and P30,000.00 as exemplary damages.
