G.R. No. 198105: PEOPLE OF THE PHILIPPINES v. JESSIE DARUCA y PILAPIL
After a careful review of the records of the case, the Court finds no reversible error in the assailed decision. However, in addition to moral damages and civil indemnity, appellant is ordered to pay AAA[1] exemplary damages in the amount of P30,000 pursuant to prevailing jurisprudence.[2]
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the 4 March 2011 Decision of the Court of Appeals in CA-G.R. CR-H.C. No. 03184 finding appellant Jessie Daruca y Pilapil guilty beyond reasonable doubt of the crime of Rape and AFFIRMS said Decision with the MODIFICATION that appellant is ordered to pay AAA exemplary damages in the amount of P30,000 pursuant to prevailing jurisprudence.
