"G.R. No. 154472 (Alexander R. Lopez, et al. v. Metropolitan Waterworks and Sewerage System).
RESOLUTION
Acting on the Letter dated January 18, 2012 by two of the petitioners, Alexander R. Lopez and Herminio Pe�a, requesting help and clarification relative to this case, the Court resolves to NOTE the same. The Decision of June 30, 2005 granted terminal leave pay and separation pay and/or severance pay only to each of the named petitioners. Nothing in the decision granted the same judgment to the bill collectors similarly situated as petitioners but not included as parties to the case. A judgment cannot bind persons who are not parties to the action.[1] Petitioners' questions on the computation of their terminal leave pay and on the execution of the judgment should be properly addressed to the Civil Service Commission (CSC) to which the Court has remanded the case for computation of the awards and enforcement of the judgment.cralaw
Also, considering petitioners' claims that until now the Decision of June 30, 2005 has not been fully executed as not all of them have received their separation pay and none of them have received their termination pay, the Court stresses that the CSC should disallow any more delays in the execution and enforcement of the decision. Otherwise, petitioners would be deprived of the fruits of the final judgment and all the effort, time and expenditure of the courts would have been for nothing.
Let the CSC be furnished with a copy of this Resolution.
No further pleadings or motions will be entertained."
