SATURNINO OCAMPO v. JUDGE EPHREM ABANDO, ET AL.
"G.R. No. 176830 - (Saturnino Ocampo v. Judge Ephrem Abando, et al.); G.R. No. 185587 - (Randall Echanis v. Judge Thelma Bunyi-Medina, et al.); G.R. No. 185636 - (Rafael Baylosis v. Judge Thelma Bunyi-Medina, et al.); G.R. No. 190005 - (Vicente Ladlad v. Judge Thelma Bunyi-Medina, et al.) - For the Court's consideration is the Manifestation dated 17 January 2012 filed by petitioner Randall Echanis.
On 11 August 2009, the Court granted petitioner Echanis provisional release upon his posting of a P100,000 cash bond and "for a period not exceeding six (6) months, unless the formal peace negotiations are earlier concluded or terminated.� After he had posted the required cash bond, this Court ordered his provisional release.[1]
On 20 July 2011, petitioner Echanis filed a Motion to Lift Conditions of Release[2] on the ground that his co-accused/co-petitioner, Saturnino Ocampo, had been granted bail by the Court upon posting a P100,000 cash bond without any further conditions.
In the 17 January 2012 Resolution subject of Echanis' instant Manifestation, the Court granted petitioner Echanis's motion, requiring him to post bail in the amount of P100,000, "all subject to the condition proposed by the Office of the Solicitor General that petitioners' temporary release shall be limited to the period of their actual participation as consultants of the CPP-NDF in the peace negotiations with the government."
In the present Manifestation, petitioner Echanis wants to clarify whether the 17 January 2012 Resolution requires him to post another P100,000 bail bond separate from what he had earlier filed.
The records show no withdrawal from the Court of the 14 August 2009 cash bond previously posted by Echanis. Hence, the P100,000 cash bond posted by petitioner Echanis is considered sufficient compliance with our 17 January 2012 Resolution. Petitioner Echanis need not file another P100,000 cash bond to secure his temporary release, subject to the conditions we had earlier imposed.
WHEREFORE, the Manifestation with Motion to Clarify Resolution dated January 17, 2012 filed by petitioner Randall Echanis is NOTED and GRANTED. The 14 August 2009 cash bond posted by Echanis is considered sufficient compliance with the Court's 17 January 2012 Resolution.
The Court further Resolves to NOTE the Certification dated February 1, 2012 of Ms. Araceli C. Bayuga, SC Chief Judicial Staff Officer, Supreme Court, stating that Rafael Baylosis posted a Cash Bond in the amount of One Hundred Thousand Pesos (P100,000.00) pursuant to the resolution dated January 17, 2012 under Official Receipt No. 0034357 dated February 1, 2012." cralaw
