G.R. No. 188084 (Ricardo J.M. Rivera v. Patricia F. Perez). - The present case is a Petition for Review on Certiorari[1] under Rule 45 of the 1997 Rules of Civil Procedure filed by petitioner Ricardo J.M. Rivera (Rivera), praying for the review and reversal of the Court of Appeals' Decision[2] dated February 13, 2009 and the reinstatement of the Resolution[3] of the City Prosecutor's Office of Pasig, charging herein respondent Patricia F. Perez (Perez) with libel.
On April 13, 2010, respondent Perez filed a Manifestation with Motion to Dismiss the Appeal[4] due to the amicable settlement between parties. Attached with the said Motion was an Affidavit of Desistance[5] dated March 22, 2010 executed by petitioner Rivera. After we required petitioner Rivera to comment on the respondent's Motion, the petitioner on April 11, 2011 filed his Comment,[6] affirming as true respondent's Manifestation and joining the respondent for the dismissal of this petition for review.cralaw
WHEREFORE, for and in consideration of the foregoing premises, the petition is hereby DISMISSED due to parties' amicable settlement.
