LORENZO HIDALGO v. PEOPLE OF THE PHILIPPINES
G.R. No. 200227 (LORENZO HIDALGO v. PEOPLE OF THE PHILIPPINES). - Considering the allegations, issues and arguments presented in the Petition for Review, the Court resolves to DENY the petition for failure to sufficiently show that the Court of Appeals committed any reversible error in its assailed Decision dated February 28, 2011 and Resolution dated December 20, 2011 as to warrant the exercise of the Court's appellate jurisdiction.
IN VIEW OF THE FOREGOING, the Court ADOPTS the findings and conclusions of law in the Decision dated February 28, 2011 and Resolution dated December 20, 2011 of the Court of Appeals in CA-G.R. CR No. 30112 and AFFIRMS said Decision and Resolution finding petitioner Lorenzo Hidalgo guilty beyond reasonable doubt of the crime of Robbery, as defined and penalized under paragraph 5 of Article 294 of the Revised Penal Code, sentencing him to suffer the penalty of imprisonment, but with MODIFICATION that petitioner is hereby made to suffer the prison term of 2 years, 4 months and 1 day of Prision Correccional medium, as minimum, to 8 years of Prision Mayor minimum, as maximum, pursuant to paragraph 5 of Article 294 of the Revised Penal Code, considering that no aggravating and mitigating circumstance attended the commission of the crime and after applying the Indeterminate Sentence Law. The award of civil indemnity in the amount of P45,000.00 and moral damages in the amount of P10,000.00 in favor of private complainant Atty. Napoleon Cruz to be paid by petitioner is hereby sustained.cralaw
