PHIL. DAIRY PROD. CORP., ET AL vs. VOLUNTARY ARBITRATOR TITO F. GENILO OF DOLE, ET AL.
THIRD DIVISION
Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated
APR 13, 1999.G.R. No. 106705 (Philippine Dairy Products Corporation and San Miguel Corporation-Magnolia Dairy Products vs. Voluntary Arbitrator Tito F. Genilo of the Department of Labor and Employment and the National Organization of Working Men (NOWN).)
In view of the letter-complaint dated September 21, 1998, filed by Voluntary Arbitrator Tito F. Genilo, stating among others that the National Bureau of Investigation (NBI) cannot render a definite opinion on the authenticity of signatures of Ricardo Dasoy, Argel Quiambao, Leonila Valdez and Jesus Punsalang, this Court resoved to GRANT the motion to execute judgment insofar as the aforesaid persons are concerned.
With regard to the second motion for execution filed by Socorro Santiago, it appears that on November 9, 1992, petitioners filed a "manifestation with motion to drop some party complainants"1 [Rollo, p. 185.] which included Socorro Santiago. Acting on the said manifestation and motion, the Court in its resolution of January 18, 1993,2 [Ibid., p. 257.] NOTED and GRANTED the same. Inasmuch as movant Socorro Santiago has been dropped as party complainant, this Court resolved to DENY the second motion for execution.
Very truly yours,
(SGD.) JULIETA Y. CARREON
