Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated APR 12, 1999.

G.R. No. 135359 (Artemio A. Adaza, Jr., et al vs. Rogelio Aberin.)

The second motion of petitioners for reconsideration of the resolution of 12 October 1998, which denied their motion for extension of time to file petition for review on certiorari, with motion to admit the petition for review on certiorari, with motion to admit the petition is DENIED for lack of prior leave to file said second motion for reconsideration; besides, petitioners' first motion for reconsideration of the said resolution of 12 October 1998 was denied with finality in the resolution of 13 January 1999.

Accordingly, the Court RESOLVES to DENY the petition for review on certiorari for failure to take the appeal within the reglementary period of fifteen (15) days in accordance with Section 2, Rule 45 in relation to Section 5(a), Rule 56 of the 1997 Rules of Civil Procedure, as amended.

Respondent's motion dated 17 March 1999 for the issuance of entry of judgment in this case is DENIED for being premature.
