Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated APR 7, 1999.
G.R. No. 136476 (Lorna Express Credit Corporation vs. Dominador A. Pantalita, et al.)
The motion of petitioner for second extension of seven (7) days from 4 February 1999 within which to file petition for review on certiorari is DENIED pursuant to the resolution of 10 February 1999 which granted petitioner a last extension of only thirty (30) days, not forty-five (45) days as prayed for, within which to file said petition, and the manifestation of petitioner dated 15 February 1999 stating that an original copy of the petition for review on certiorari was filed on 15 February 1999 and that other copies of the petition were personally filed on 17 February 1999 and praying that the attached copies of said petition to be admitted is NOTED WITHOUT ACTIONS.
In accordance with Rule 45 in relation to Rule 56 and other pertinent provisions of the 1997 Rules of Civil Procedure, as amended, governing appeals by certiorari to the Supreme Court, only petitions which comply strictly with the requirements specified therein shall be entertained. On the basis thereof, the Court RESOLVES to DENY the petition for review on certiorari with prayer for restraining order and/or preliminary injunction for petitioner's failure to:
(a)������� take the appeal within the extended period of thirty (30) days granted in the resolution of 10 February 1999 in accordance with Section 2, Rule 45 in relation to Section 5(a), Rule 56;
(b)������� remit the amount of P202.00
as deposit for sheriff's fees and clerk's commission in accordance with Section
3. Rule 45 in relation to Section 5(c), Rule 56; and
(c)������� state the material dates of the receipt of the questioned decision of the Court of Appeals, of the filing of the motion for reconsideration of the said decision and of the receipt of the resolution denying the motion in accordance with Section 4(b) and 5, Rule 45 in relation to Section 5(d), Rule 56.
