G.R. No. 140526(Juriya T. Ahmad vs. Hon. Court of Appeals and Civil Service Commission.)

Acting on the special civil action for certiorari with preliminary injunction and temporary restraining order, the Court Resolved to DISMISS the petition, for failure to pay deposit for costs and Sheriff a fee of P20.00.

In any event, if treated under Rule 45, petition was filed late, and if treated under Rule 65, certiorari is not a substitute for a lapsed appeal."
