Gentlemen :

Quoted hereunder, for your information, is a resolution of this Court dated DEC 7, 1999 .

A.M. No. 98-5-154-RTC( Judicial Audit Report, Regional Trial Court, Branches 33 and 67, Bauang, La Union.)

In the resolution, dated June 23, 1998, the Court ordered (1) Judge Rose Mary M. Alim, Regional Trial Court, Branch 33, Bauang, La Union to inform the Court of the status of five cases and to act on 31 cases; (2) Judge Jose O. Paneda, Regional Trial Court, Branch 67, Bauang, La Union to inform the Court of the status of 20 cases and to act on 40 cases; and (3) Branch Clerk of Court Nida Q. Rodriguera, Regional Trial Court, Branch 33, Bauang, La Union (a) to explain why no administrative sanction should be imposed on her for failure to submit her reports on two cases in which she was commissioned to receive evidence; and (b) to submit a list of Stenographers who have not submitted their transcripts of stenographic notes in cases submitted for decision in the Regional Trial Court, Branch 33, Bauang, La Union, to direct them to explain their failure to do so, and to require them to transmit the said transcripts of stenographic notes to the Office of the Court Administrator.

In compliance with the Court's resolution, reports were submitted by Judge Molina-Alim and Branch Clerk of Court Rodriguera, both of which were duly noted in the resolution, dated July 20, 1999. For failure to submit his report and comply with the said resolution, Judge Paneda was ordered to show cause why no disciplinary action should be taken against him.

In his letter, dated September 10, 1999, Judge Paneda explained that he submitted a report, dated September 3, 1998, in compliance with resolution dated June 23, 1998, which must have been lost in transit. He attached a copy of the report to his letter.

Considering the foregoing, the Court RESOLVED as follows:

(1) To NOTE the letter, dated September 10, 1999 of Judge Jose G. Paneda; and (2) to DIRECT (a) Judge Rose Mary M. Alim to explain within ten (10) days from notice hereof why no administrative sanction should be imposed on her for her failure to decide Criminal Case No.1204-BG and for her failure to act on Civil Case No. 644-BG within a reasonable period of time; (b) Judge Jose G. Paneda to explain within ten (10) days from notice hereof why no administrative sanction should be imposed on him for his failure to decide on time Criminal Case Nos. 1235.BG, 1868-BG, 1883-BG, 1414-HG, 1611-BG, 1754-BG, 1839-BG, and 1876-BG and Civil Case Nos. 594-BG, 846-BG, 872-BG, 1077-BG, SCA�25-BG, SCA-41-BG, 995-BG, 1005-BG, and SP-349-BG and for his failure to act on Civil Case Nos. 970-BG, 1045-BG, 1134-BG and 199-LRC within a reasonable period of time; and (c) Branch Clerk of Court Nida Q. Rodriguera to inform the Court within ten (10) days from notice hereof whether the stenographic notes taken by Luella A. Zimmerman during the hearing on January 19, 1995 in Civil Case No. LRC-237-BG are available and, if so, to assign another stenographer to transcribe the same.
